AN ACT

RELATING TO COURTS; TRANSFERRING JUDGES SERVING IN THE BERNALILLO COUNTY METROPOLITAN COURT TO THE SECOND JUDICIAL DISTRICT; PROVIDING FOR ELECTIONS; AMENDING AND REPEALING SECTIONS OF THE NMSA 1978.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. Section 34-6-5 NMSA 1978 (being Laws 1968, Chapter 69, Section 8, as amended) is amended to read:

     "34-6-5. JUDGES--SECOND JUDICIAL DISTRICT.--There shall be [twenty-three] thirty-nine district judges in the second judicial district."

     Section 2. REPEAL.--Sections 34-8A-1 through 34-8A-13 NMSA 1978 (being Laws 1979, Chapter 346, Sections 1 through 4, Laws 1981, Chapter 318, Section 2, Laws 1979, Chapter 346, Sections 5 through 8, Laws 1987, Chapter 20, Section 4 and Laws 1993, Chapter 261, Sections 5 and 6, as amended) are repealed.

     Section 3. TEMPORARY PROVISION--ASSIGNMENT OF JUDGES, PERSONNEL, APPROPRIATIONS, CONTRACTS AND OBLIGATIONS.--On the effective date of the provisions of this act, judges serving in the Bernalillo county metropolitan court are transferred to the second judicial district, together with all personnel, appropriations, money, records, real property, furniture, equipment, office supplies and all contracts, liabilities or other obligations attributable to the Bernalillo county metropolitan court.

     Section 4. TEMPORARY PROVISION--ELECTION.--The Bernalillo county metropolitan court judges transferred to the second judicial district shall begin serving as district judges on July 1, 2004 and shall serve until succeeded by a district judge elected at the general election in 2006.

     Section 5. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2004.
