AN ACT

RELATING TO STATE LAND; PROVIDING FOR RESTRICTIONS ON USE OF STATE LAND FOR A URANIUM ENRICHMENT FACILITY; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. CONVEYANCE OF STATE LAND--RESTRICTION.--The commissioner of public lands shall not sell, lease or otherwise convey state land for use as the site of a uranium enrichment facility unless the facility is economically feasible as determined by the department of environment. The department of environment shall adopt rules for approval of a uranium enrichment facility, and the rules shall include a requirement for adequate funding of waste storage.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
