AN ACT

RELATING TO AIR POLLUTION; REQUIRING NEW MEXICO GASOLINE STATIONS TO INSTALL FUNCTIONING VAPOR RECOVERY NOZZLES AT GASOLINE PUMPS; PROVIDING A PENALTY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. VAPOR RECOVERY NOZZLES REQUIRED--PENALTY.--

          A. An owner of a gasoline station that sells gasoline in New Mexico shall install a functioning vapor recovery nozzle at each gasoline pump at that gasoline station from which gasoline is dispensed.

          B. A person who violates a provision of this section is guilty of a misdemeanor and shall be punished by the imposition of a fine of not more than one thousand dollars ($1,000) for each violation.

          C. For the purposes of this section, "vapor recovery nozzle" means a nozzle that is used at a gasoline pump and that captures gasoline vapor that escapes from an automobile tank when the automobile is refueled.

     Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is January 1, 2006.
