    Your GOVERNMENT AND URBAN AFFAIRS COMMITTEE, to whom has been referred

HOUSE BILL 357

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

     1. On page 1, line 16, after "STATES" insert "; PROVIDING A PENALTY".

     2. On page 7, lines 24 through 25, strike Subsection B in its entirety.

     3. Reletter the succeeding subsections accordingly.

     4. On page 17, between lines 18 and 19, insert the following new sections to read:

     "Section 12. PENALTY.--A person who performs lead-based paint services without a certification or accreditation from the department is guilty of a petty misdemeanor and shall be sentenced pursuant to Section 31-19-1 NMSA 1978.

     Section 13. DELAYED REPEAL.--Sections 1 through 12 of this act are repealed effective July 1, 2010.".

and thence referred to the BUSINESS AND INDUSTRY COMMITTEE.
