AN ACT

RELATING TO ELECTIONS; PROVIDING FOR IDENTIFICATION OF VOTERS WHO HAVE VOTED ON ELECTION DAY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of the Election Code is enacted to read:

     "[NEW MATERIAL] CONDUCT OF ELECTIONS--MARKING VOTERS.--A voter's thumb or finger shall be marked with indelible ink after the voter casts a ballot in an election covered by the Election Code. Notwithstanding any other required voting procedures, a person already marked in such manner shall not be allowed to cast a ballot on election day. The secretary of state shall establish procedures implementing the requirements of this section."
