AN ACT

RELATING TO TRIALS; PROHIBITING RETROACTIVE RULES OF LAW.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 38, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] RETROACTIVE RULES--PROHIBITED.--The courts of this state shall not create rules of law that apply retroactively, including rules of law that would apply to conduct that occurred prior to the time of the filing of a cause of action arising out of that conduct."
