AN ACT

RELATING TO CULTURAL AFFAIRS; CREATING THE NEW MEXICO MUSIC COMMISSION; PROVIDING POWERS AND DUTIES; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. NEW MEXICO MUSIC COMMISSION--CREATED--MEMBERSHIP--POWERS AND DUTIES--DIRECTOR.--

          A. The "New Mexico music commission" is created to protect, promote and preserve New Mexico's musical traditions and music industry. The commission is composed of seven members appointed by the governor who represent the musical traditions and music industry of the state. Members serve at the pleasure of the governor. The governor shall appoint the chairperson and vice chairperson of the commission. Members of the commission are entitled to per diem and mileage as provided in the Per Diem and Mileage Act, but shall receive no other compensation, perquisite or allowance.

          B. The commission:

                (1) shall appoint a director to carry out the functions of the commission;

                (2) shall develop a musical directory of services, venues and performances in New Mexico;

                (3) may propose or consider and evaluate other proposals for specific projects that will protect New Mexico's musical traditions or promote the music industry in New Mexico; and

                (4) may adopt and promulgate rules in accordance with the State Rules Act to carry out its duty to protect, promote and preserve New Mexico's musical traditions and music industry.

     Section 2. APPROPRIATION.--One hundred thousand dollars ($100,000) is appropriated from the general fund to the cultural affairs department for expenditure in fiscal year 2006 to support the New Mexico music commission. Any unexpended or unencumbered balance remaining at the end of fiscal year 2006 shall revert to the general fund.
