AN ACT

MAKING APPROPRIATIONS TO THE ENERGY, MINERALS AND NATURAL RESOURCES DEPARTMENT FOR STATE PARKS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATIONS.--

          A. One million seven hundred thousand dollars ($1,700,000) is appropriated from the general fund to the energy, minerals and natural resources department for expenditure in fiscal year 2005 and subsequent fiscal years to pay for nonrecurring capital and other costs associated with the expansion of five existing state parks, building four new state parks and projects at Cerrillos hills in Santa Fe county and the Blackwater Draw site in Roosevelt county. Two hundred fifty thousand dollars ($250,000) of the funds appropriated in this subsection shall be expended to pay for the capital equipment and operation of the proposed Vietnam veterans' memorial state park in Colfax county.

          B. Two hundred four thousand two hundred dollars ($204,200) is appropriated from the general fund to the energy, minerals and natural resources department for expenditure in fiscal year 2006 to pay for the operations of the proposed Vietnam veterans' memorial state park in Colfax county.

          C. The appropriations in Subsections A and B of this section for the Vietnam veterans' memorial state park are contingent upon the state parks division of the energy, minerals and natural resources department acquiring ownership of the property for the Vietnam veterans' memorial state park.           D. Any unexpended or unencumbered balance remaining at the end of a fiscal year shall not revert to the general fund.
