AN ACT

RELATING TO THE ENVIRONMENT; PROVIDING AN AMNESTY PERIOD FOR REGISTRATION OF STORAGE TANKS; PROVIDING FOR REGISTRATION WITHOUT PAYMENT OF FEES OR PENALTIES DURING THE AMNESTY PERIOD; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. TEMPORARY PROVISION--STORAGE TANK AMNESTY PERIOD.--The provisions of the Hazardous Waste Act and the Ground Water Protection Act notwithstanding, any person who owns a storage tank that has not been registered or for which annual fees have not been paid as provided in those acts, has one hundred twenty days from the effective date of this act to register the storage tank and pay the current registration fee. The department of environment shall not assess any past fees or penalties for failure to register or for having an unregistered tank. The amnesty provided in this section applies to storage tanks on which there are no pending department actions on the effective date of this act.

     Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
