A JOINT RESOLUTION

PROPOSING AN AMENDMENT TO ARTICLE 8 OF THE CONSTITUTION OF NEW MEXICO TO ESTABLISH A PROVISION TO EXEMPT FROM TAXATION THE PROPERTY OF EVERY PERSON WHOSE FAMILY OR HOUSEHOLD INCOME IS AT OR BELOW THE POVERTY LEVEL OR IS DETERMINED TO BE BLIND OR DISABLED.

 

BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. It is proposed to amend Article 8 of the constitution of New Mexico by adding a new section to read:

     "The legislature shall exempt from taxation the property of every person whose family or household income is at or below the federal poverty level and who:

          A. is determined to be blind or permanently disabled with medical improvement not expected pursuant to 42 U.S.C. 421 for purposes of the federal Social Security Act; and

          B. is determined to have a permanent total disability pursuant to the Worker's Compensation Act."

     Section 2. The amendment proposed by this resolution shall be submitted to the people for their approval or rejection at the next general election or at any special election prior to that date that may be called for that purpose.
