AN ACT

MAKING AN APPROPRIATION TO THE ATTORNEY GENERAL FOR THE PURPOSE OF PREPARING AND FILING A LAWSUIT AGAINST THE UNITED STATES FOR FAILURE TO PROVIDE SUFFICIENT FUNDING FOR INDIAN HEALTH CARE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. APPROPRIATION.--Five hundred thousand dollars ($500,000) is appropriated from the general fund to the office of the attorney general for expenditure in fiscal years 2009 and 2010 for the purpose of preparing and filing a lawsuit against the United States for failure to provide sufficient funding for Indian health care. Any unexpended or unencumbered balance remaining at the end of fiscal year 2010 shall revert to the general fund.
