AN ACT

RELATING TO HIGHER EDUCATION; PROVIDING FOR COMPETITIVE SCHOLARSHIPS TO ALLOW FOR IN-STATE TUITION AND FEE RATES FOR NONRESIDENTS AT ALL STATE EDUCATIONAL INSTITUTIONS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. A new section of Chapter 21, Article 1 NMSA 1978 is enacted to read:

     "[NEW MATERIAL] COMPETITIVE SCHOLARSHIPS FOR OUT-OF-STATE STUDENTS.--

          A. Each state educational institution may grant competitive scholarships on a merit basis to out-of-state undergraduate students. Students granted competitive scholarships are eligible to receive in-state tuition at the state educational institution. The number of competitive scholarships granted by each state educational institution shall not exceed six percent of that state educational institution's full-time equivalent enrollment of the previous year.

          B. The higher education department shall adopt and promulgate rules to carry out the provisions of Subsection A of this section and maintain the necessary records to assure that requirements are met."
