AN ACT

RELATING TO CAPITAL OUTLAY; REVERTING BALANCES OF CERTAIN GENERAL FUND APPROPRIATIONS; TRANSFERRING BALANCES TO THE GENERAL FUND; AUTHORIZING CERTAIN SEVERANCE TAX BOND APPROPRIATIONS; PROVIDING FOR REVERSION OF CERTAIN BALANCES; DECLARING AN EMERGENCY.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     Section 1. GENERAL FUND BALANCES REVERTED.--Notwithstanding any provision of law to the contrary, the unexpended balance up to the amount specified of the following appropriations shall not be expended and shall revert to the general fund pursuant to procedures, policies and deadlines established by the financial control division of the department of finance and administration:

          1. four hundred thousand dollars ($400,000) to the aging and long-term services department in Subsection 27 of Section 33 of Chapter 92 of Laws 2008 to purchase and equip vehicles for senior centers nationwide on the Navajo Nation in McKinley, San Juan, Cibola, Bernalillo and Sandoval counties;

          2. one million five hundred thousand dollars ($1,500,000) to the state armory board in Laws 2007, Chapter 2, Section 3 for renovations at armory facilities statewide;

          3. four hundred thousand dollars ($400,000) to the capital program fund in Subsection 2 of Section 64 of Chapter 111 of Laws 2006 to plan, design, construct, renovate and equip the department of public safety district office in Albuquerque in Bernalillo county;

          4. ten thousand dollars ($10,000) to the capital program fund in Subsection 2 of Section 35 of Chapter 92 of Laws 2008 to plan, design and construct a safety inspection station at the Santa Teresa port of entry in Santa Teresa in Dona Ana county;

          5. one million four hundred ninety-nine thousand two hundred thirty-nine dollars ($1,499,239) originally appropriated to the capital program fund in Subsection 1 of Section 52 of Chapter 110 of Laws 2002 and reauthorized in Laws 2003, Chapter 429, Section 138; in Laws 2007, Chapter 341, Section 112; and finally in Laws 2009, Chapter 128, Section 246 to complete phase 2 construction and equip and install a platform static scale at the Santa Teresa port of entry in Dona Ana county and to design, construct, equip and furnish a building for the border authority at the Santa Teresa border crossing in Dona Ana county;

          6. one hundred forty-six thousand nine hundred fifty-one dollars ($146,951) of the original appropriation to the public education department in Subsection 442 of Section 55 of Chapter 42 of Laws 2007, which was reauthorized and reappropriated to the capital program fund in Paragraph (1) of Subsection B of Section 210 of Chapter 83 of Laws 2008, to plan, design, construct, equip and furnish a safety inspection station in Santa Teresa in Dona Ana county;

          7. one million one hundred thousand dollars ($1,100,000) to the capital program fund in Subsection 12 of Section 64 of Chapter 111 of Laws 2006 to plan, design and construct a motor vehicles department field office in Santa Fe in Santa Fe county;

          8. five hundred thousand dollars ($500,000) to the capital program fund in Subsection 12 of Section 38 of Chapter 42 of Laws 2007 for emergency repairs to state buildings statewide;

          9. one million five hundred thousand dollars ($1,500,000) to the capital program fund in Subsection 13 of Section 38 of Chapter 42 of Laws 2007 to plan, design and construct improvements to state buildings statewide, including funding for contingencies;

          10. one hundred twenty-five thousand dollars ($125,000) to the cultural affairs department in Subsection 6 of Section 41 of Chapter 42 of Laws 2007 to plan, design and construct a retractable cover for the courtyard at the New Mexico farm and ranch heritage museum in Las Cruces in Dona Ana county;

          11. one million five hundred thousand dollars ($1,500,000) to the cultural affairs department in Subsection 12 of Section 30 of Chapter 347 of Laws 2005 to plan, design and construct a New Mexico archaeology center in Santa Fe county to serve as a research and collections repository for the state's archaeological collection;

          12. nine hundred thousand dollars ($900,000) to the cultural affairs department in Laws 2006, Chapter 111, Section 75 to complete construction of the center for archaeology on property donated by the United States bureau of land management in Santa Fe in Santa Fe county;

          13. fifty thousand dollars ($50,000) to the thirteenth judicial district court in Subsection 1 of Section 52 of Chapter 42 of Laws 2007 to purchase and install information technology, including related equipment and furniture, for the thirteenth judicial district court in Cibola county;

          14. three million five hundred thousand dollars ($3,500,000) to the economic development department in Subsection 1 of Section 43 of Chapter 92 of Laws 2008 to provide grants to political subdivisions of the state to achieve job growth by attracting new companies or expanding existing businesses pursuant to the Local Economic Development Act;

          15. five million dollars ($5,000,000) to the economic development department in Subsection 5 of Section 32 of Chapter 347 of Laws 2005 to make needed investments to stimulate economic development statewide;

          16. one million two hundred fifty thousand dollars ($1,250,000) to the economic development department in Subsection 2 of Section 53 of Chapter 42 of Laws 2007 to plan, design and construct the redevelopment of central business districts as part of the mainstreet program statewide;

          17. one hundred twenty-two thousand seven hundred sixty dollars ($122,760) to the public education department in Subsection 1 of Section 44 of Chapter 92 of Laws 2008 to design, construct and equip a facility for Media Arts Collaborative charter school in Bernalillo county;

          18. fifty thousand dollars ($50,000) to the public education department in Subsection 11 of Section 55 of Chapter 42 of Laws 2007 to improve the heating, ventilation and air conditioning system at A. Montoya elementary school in the Albuquerque public school district in Bernalillo county;

          19. one hundred forty-eight thousand five hundred dollars ($148,500) to the public education department in Subsection 59 of Section 55 of Chapter 42 of Laws 2007 to plan, design, construct, improve and equip the administrative area at Comanche elementary school in the Albuquerque public school district in Bernalillo county;

          20. eighty thousand dollars ($80,000) to the public education department in Subsection 20 of Section 16 of Chapter 2 of Laws 2007 to plan, design and construct a play area at Douglas MacArthur elementary school in the Albuquerque public school district in Bernalillo county;

          21. seventy-five thousand dollars ($75,000) to the public education department in Subsection 21 of Section 16 of Chapter 2 of Laws 2007 to make improvements to the patio at Duranes elementary school in the Albuquerque public school district in Bernalillo county;

          22. one hundred thousand dollars ($100,000) to the public education department in Subsection 83 of Section 55 of Chapter 42 of Laws 2007 to plan, design and construct a drop-off and pick-up area for the students at Emerson elementary school in the Albuquerque public school district in Bernalillo county;

          23. two hundred thousand dollars ($200,000) to the public education department in Subsection 131 of Section 55 of Chapter 42 of Laws 2007 to plan, design and construct a playground, including purchase and installation of equipment and turf, at John Baker elementary school in the Albuquerque public school district in Bernalillo county;

          24. two hundred twenty-five thousand dollars ($225,000) to the public education department in Subsection 34 of Section 16 of Chapter 2 of Laws 2007 to plan, design and construct a playground, including purchase and installation of equipment and turf, at John Baker elementary school in the Albuquerque public school district in Bernalillo county;

          25. one hundred thousand dollars ($100,000) to the public education department in Subsection 161 of Section 44 of Chapter 92 of Laws 2008 to purchase and install books and improvements at the library at La Mesa elementary school in the Albuquerque public school district in Bernalillo county;

          26. four hundred twenty-five thousand dollars ($425,000) to the public education department in Subsection 160 of Section 55 of Chapter 42 of Laws 2007 to purchase and install equipment and plan, design and improve the football field, including landscaping, at Manzano high school in the Albuquerque public school district in Bernalillo county;

          27. one hundred thousand dollars ($100,000) to the public education department in Subsection 220 of Section 44 of Chapter 92 of Laws 2008 to plan, design, construct and improve infrastructure at the field at Navajo elementary school in the Albuquerque public school district in Bernalillo county;

          28. thirty-five thousand dollars ($35,000) originally appropriated to the local government division in Subsection 604 of Section 52 of Chapter 111 of Laws 2006 and reauthorized and reappropriated to the public education department in Laws 2009, Chapter 128, Section 134 to plan, design, construct and equip a facility, including site improvements, for the behavioral intervention program at Sandia high school in the Albuquerque public school district in Bernalillo county;

          29. one hundred thousand dollars ($100,000) to the public education department in Subsection 286 of Section 44 of Chapter 92 of Laws 2008 to plan, design, construct and improve the Valley high school soccer field in the Albuquerque public school district in Bernalillo county;

          30. one hundred twenty-five thousand dollars ($125,000) to the public education department in Subsection 261 of Section 55 of Chapter 42 of Laws 2007 to plan, design and construct a baseball field at Van Buren middle school in the Albuquerque public school district in Bernalillo county;

          31. one hundred fifty thousand dollars ($150,000) to the public education department in Subsection 288 of Section 44 of Chapter 92 of Laws 2008 to plan, design, construct and renovate the track and field facility, including bleachers, at Van Buren middle school in the Albuquerque public school district in Bernalillo county;

          32. one hundred ninety-five thousand dollars ($195,000) to the public education department in Subsection 300 of Section 44 of Chapter 92 of Laws 2008 to construct a school bus drop-off area at Wherry elementary school in the Albuquerque public school district in Bernalillo county;

          33. two hundred thousand dollars ($200,000) to the public education department in Subsection 317 of Section 55 of Chapter 42 of Laws 2007 to plan, design, construct and equip a building for the football weight room at Roswell high school in the Roswell independent school district in Chaves county;

          34. one hundred ninety-eight thousand dollars ($198,000) to the public education department in Subsection 331 of Section 55 of Chapter 42 of Laws 2007 to construct classrooms at Gadsden middle school in the Gadsden independent school district in Dona Ana county for use by New Mexico integrated services, the New Mexico community foundation and the department of health;

          35. three hundred seventy-five thousand dollars ($375,000) to the public education department in Subsection 343 of Section 55 of Chapter 42 of Laws 2007 to purchase land for, plan, design, construct and equip schools and multipurpose facilities, including a girls' softball practice field, for the Las Cruces public school district in Dona Ana county;

          36. one hundred thousand dollars ($100,000) to the public education department in Subsection 408 of Section 44 of Chapter 92 of Laws 2008 to plan, design, construct, purchase and install renovations to the heating, ventilation and air conditioning systems at West Las Vegas middle and Union elementary schools in the west Las Vegas public school district in San Miguel county;

          37. one hundred seventy thousand dollars ($170,000) to the public education department in Subsection 430 of Section 55 of Chapter 42 of Laws 2007 to plan, design and construct a roof replacement at Eldorado elementary school in the Santa Fe public school district in Santa Fe county;

          38. one hundred thousand dollars ($100,000) to the public education department in Subsection 432 of Section 55 of Chapter 42 of Laws 2007 to plan, design and construct a roof replacement for Gonzales elementary school in the Santa Fe public school district in Santa Fe county;

          39. one million seven hundred fifty thousand dollars ($1,750,000) originally appropriated to the local government division in Subsection 699 of Section 52 of Chapter 111 of Laws 2006 and reauthorized and reappropriated to the public education department in Laws 2007, Section 341, Subsection 333 to plan, design and construct a cultural arts center at Moriarty high school in the Moriarty municipal school district in Torrance county;

          40. one hundred forty-eight thousand five hundred dollars ($148,500) to the public education department in Subsection 451 of Section 55 of Chapter 42 of Laws 2007 to design, construct and equip the gymnasium at Dennis Chavez elementary school in the Belen consolidated school district in Valencia county;

          41. eighty thousand dollars ($80,000) to the public education department in Subsection 456 of Section 55 of Chapter 42 of Laws 2007 for connection of Ann Parish elementary school to the Cypress Gardens community water system in the Los Lunas public school district in Valencia county;

          42. one hundred fifty-eight thousand four hundred dollars ($158,400) to the public education department in Subsection 457 of Section 55 of Chapter 42 of Laws 2007 to plan, design and renovate a building for Bosque Farms elementary school in the Los Lunas public school district in Valencia county;

          43. one hundred thousand dollars ($100,000) to the public education department in Subsection 459 of Section 55 of Chapter 42 of Laws 2007 to purchase and install improvements, including lighting, to the soccer fields at Los Lunas high school in the Los Lunas public school district in Valencia county;

          44. three hundred eighty-five thousand dollars ($385,000) to the state parks division of the energy, minerals and natural resources department in Subsection 1 of Section 57 of Chapter 42 of Laws 2007 to plan, design, construct and equip an education facility at Rio Grande nature center state park in Albuquerque in Bernalillo county;

          45. one hundred forty-five thousand dollars ($145,000) to the office of the state engineer in Subsection 1 of Section 58 of Chapter 42 of Laws 2007 to purchase land for, plan, design, construct, equip and install pump stations, storm drainage improvements and emission and detention basins in the Barelas and Martineztown areas of Albuquerque in Bernalillo county;

          46. one hundred thousand dollars ($100,000) to the office of the state engineer in Subsection 2 of Section 58 of Chapter 42 of Laws 2007 to acquire land for and plan, design and construct dams for flood control in the east mesa area of Dona Ana county;

          47. seven hundred fifty thousand dollars ($750,000) to the office of the state engineer in Subsection 6 of Section 58 of Chapter 42 of Laws 2007 to rebuild a diversion structure on Gallinas creek in Las Vegas in San Miguel county;

          48. five hundred thousand dollars ($500,000) to the office of the state engineer in Subsection 6 of Section 20 of Chapter 2 of Laws 2007 to repair and rehabilitate acequia water storage projects statewide;

          49. eight hundred fifty thousand dollars ($850,000) to the office of the state engineer in Subsection 9 of Section 58 of Chapter 42 of Laws 2007 to repair and rehabilitate acequia water storage projects statewide;

          50. two hundred ninety-nine thousand two hundred eighty-five dollars ($299,285) to the department of environment in Subsection 11 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct a wastewater system in Tijeras in Bernalillo county;

          51. nine hundred fifty-three thousand four hundred dollars ($953,400) to the department of environment in Subsection 1 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct water system improvements in Tijeras in Bernalillo county;

          52. one hundred twenty-five thousand dollars ($125,000) originally appropriated to the department of environment in Subsection 15 of Section 59 of Chapter 42 of Laws 2007 and reauthorized in Laws 2009, Chapter 128, Section 158 to plan, design and construct improvements to a water system, including purchasing and installing fire hydrants and related equipment, for the Greenfield mutual domestic water consumers cooperative in Chaves county;

          53. one hundred thousand dollars ($100,000) to the department of environment in Subsection 18 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct water system improvements for the Bluewater Acres domestic water users association in Cibola county;

          54. one hundred forty-five thousand dollars ($145,000) to the department of environment in Subsection 14 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct utility improvements to First and Second streets and to Roosevelt avenue in Grants in Cibola county;

          55. one hundred ten thousand dollars ($110,000) to the department of environment in Subsection 27 of Section 48 of Chapter 92 of Laws 2008 to plan, design, construct, purchase and install equipment and related infrastructure for the West Hatfield-El Camino Real project water system improvements, including water main and fire hydrants, for the Dona Ana mutual domestic water consumers association in Dona Ana county;

          56. one hundred fifty-five thousand dollars ($155,000) to the department of environment in Subsection 37 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct improvements to the drinking water system to address arsenic content in Anthony in Dona Ana county;

          57. seventy-five thousand dollars ($75,000) to the department of environment in Subsection 47 of Section 48 of Chapter 92 of Laws 2008 to purchase water rights for, plan, design and construct water system improvements to connect the Otis mutual domestic water consumers and sewage works association system with the Malaga mutual domestic water consumers and sewage works association system in Eddy county;

          58. one hundred thousand dollars ($100,000) to the department of environment in Subsection 46 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct water system improvements for the Malaga mutual domestic water consumers and sewage works association in Eddy county;

          59. five hundred thousand dollars ($500,000) to the department of environment in Subsection 67 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct improvements to the water and wastewater system in Silver City in Grant county;

          60. one hundred forty thousand dollars ($140,000) to the department of environment in Subsection 57 of Section 48 of Chapter 92 of Laws 2008 to plan, design, construct and install improvements to the water system for the Hollywood Ranch domestic water users association in Guadalupe county;

          61. one hundred forty-two thousand dollars ($142,000) to the department of environment in Subsection 65 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct improvements, including cells, to the northwest New Mexico regional solid waste authority in McKinley county;

          62. two hundred fifty thousand dollars ($250,000) to the department of environment in Subsection 84 of Section 45 of Chapter 111 of Laws 2006 for water system improvements, including the purchase, construction and installation of a water tank, in Wagon Mound in Mora county;

          63. two million four hundred thousand dollars ($2,400,000) to the department of environment in Subsection 12 of Section 21 of Chapter 2 of Laws 2007 to plan, design and construct a pipeline on the eastern portion of the Navajo Nation in McKinley and San Juan counties;

          64. four hundred fifty thousand dollars ($450,000) to the department of environment in Subsection 14 of Section 21 of Chapter 2 of Laws 2007 to plan, design and construct the development of salt basin water resources in southern New Mexico;

          65. three hundred thousand dollars ($300,000) to the department of environment in Subsection 133 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct a wastewater system in Flora Vista in San Juan county;

          66. three hundred thousand dollars ($300,000) to the department of environment in Subsection 132 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct infrastructure for the water system for the Blanco mutual domestic water consumers and mutual sewage works association in San Juan county;

          67. four hundred fifty thousand dollars ($450,000) to the department of environment in Subsection 125 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct a wastewater treatment system in Kirtland in San Juan county;

          68. one hundred ten thousand dollars ($110,000) to the department of environment in Subsection 109 of Section 48 of Chapter 92 of Laws 2008 to plan, design, construct and install water system improvements for the Pena Blanca mutual domestic water consumers and mutual sewage works associations in Sandoval county;

          69. six hundred fifty thousand dollars ($650,000) to the department of environment in Subsection 106 of Section 48 of Chapter 92 of Laws 2008 to plan, design, construct and equip a deep-aquifer water desalination system, including water gathering, water treatment and water transport, in Sandoval county;

          70. one hundred thousand dollars ($100,000) to the department of environment in Subsection 107 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct wastewater system and facility improvements in Cuba in Sandoval county;

          71. three hundred fifty thousand dollars ($350,000) to the department of environment in Subsection 152 of Section 59 of Chapter 42 of Laws 2007 to plan, design, construct and improve the wastewater treatment system in Cuba in Sandoval county;

          72. two hundred twenty-five thousand dollars ($225,000) to the department of environment in Subsection 151 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct water and wastewater system improvements in Cuba in Sandoval county;

          73. one hundred fifty thousand dollars ($150,000) to the department of environment in Subsection 102 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct water system improvements, including a commercial well, for arsenic remediation and increased water supply for the Jemez Springs domestic water association in Sandoval county;

          74. three hundred thousand dollars ($300,000) to the department of environment in Subsection 142 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct a wastewater line in Rio Rancho in Sandoval county;

          75. five hundred thousand dollars ($500,000) to the department of environment in Subsection 160 of Section 59 of Chapter 42 of Laws 2007 for acquiring water rights, including needed applications and transfers, for improvements to the water distribution system and wells and for planning a sewer system in Agua Fria in Santa Fe county;

          76. one hundred fifty thousand dollars ($150,000) to the department of environment in Subsection 175 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct water storage tank improvements, including improvements to transmission lines and infrastructure, for the Eldorado area water and sanitation district in Santa Fe county;

          77. one hundred ten thousand dollars ($110,000) to the department of environment in Subsection 113 of Section 48 of Chapter 92 of Laws 2008 to plan, design and improve the water system for La Cienega mutual domestic water consumers and mutual sewage works in Santa Fe county;

          78. two hundred thirty thousand dollars ($230,000) to the department of environment in Subsection 178 of Section 59 of Chapter 42 of Laws 2007 to plan, design and construct water system improvements for La Cienega mutual domestic water consumers association and mutual sewage works, including purchasing and installing water lines, tanks, valves, fire hydrants and meters, in La Cienega in Santa Fe county;

          79. seven hundred thousand dollars ($700,000) to the department of environment in Subsection 171 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct the community treatment plant in Santa Fe in Santa Fe county;

          80. one hundred twenty-five thousand dollars ($125,000) to the department of environment in Subsection 130 of Section 48 of Chapter 92 of Laws 2008 to plan, design and construct water and wastewater system improvements, including new lines and lift stations, in Clayton in Union county;

          81. two hundred thousand dollars ($200,000) to the department of environment in Subsection 202 of Section 45 of Chapter 111 of Laws 2006 to plan, design and construct improvements to the eastside well, including arsenic mitigation, in Los Lunas in Valencia county;

          82. three million dollars ($3,000,000) to the department of finance and administration in Subsection 5 of Section 50 of Chapter 92 of Laws 2008 to plan, design and construct infrastructure improvements for colonias statewide;

          83. three million forty-two thousand nine hundred thirty-four dollars ($3,042,934) originally appropriated to the department of finance and administration in Subsection 3 of Section 31 of Chapter 126 of Laws 2004 and reauthorized in Laws 2009, Chapter 128, Section 3 to plan, design, construct, equip and furnish a film production education and training center and studio;

          84. two million dollars ($2,000,000) to the department of finance and administration in Subsection 6 of Section 61 of Chapter 42 of Laws 2007 to provide funding for tribal infrastructure projects related to water, wastewater, electrical systems, communications, roads, health, emergency facilities and economic development statewide;

          85. one hundred thousand dollars ($100,000) to the Indian affairs department in Subsection 6 of Section 66 of Chapter 42 of Laws 2007 to plan, design and construct a judicial complex at the Pueblo of Isleta in Bernalillo county;

          86. one hundred thousand dollars ($100,000) to the Indian affairs department in Subsection 17 of Section 66 of Chapter 42 of Laws 2007 to plan, design, construct and make improvements to the public water system at the Pueblo of Laguna in Cibola county;

          87. forty-five thousand dollars ($45,000) to the Indian affairs department in Subsection 16 of Section 55 of Chapter 92 of Laws 2008 to plan, design, renovate and construct an expansion of the chapter house at the Baahaali chapter of the Navajo Nation in McKinley county;

          88. seventy-five thousand dollars ($75,000) to the Indian affairs department in Subsection 36 of Section 66 of Chapter 42 of Laws 2007 to plan and construct a maintenance patrol yard for use by the chapters of Baahaali, Chichiltah and Red Rock in the Baahaali chapter of the Navajo Nation in McKinley county;

          89. one hundred fourteen thousand dollars ($114,000) to the Indian affairs department in Subsection 34 of Section 66 of Chapter 42 of Laws 2007 to plan, design and construct powerline extensions in the Baahaali chapter of the Navajo Nation in McKinley county;

          90. one hundred thousand dollars ($100,000) to the Indian affairs department in Subsection 41 of Section 66 of Chapter 42 of Laws 2007 to renovate and expand the chapter house in the Coyote Canyon chapter of the Navajo Nation in McKinley county;

          91. five hundred thousand dollars ($500,000) to the Indian affairs department in Subsection 42 of Section 66 of Chapter 42 of Laws 2007 for infrastructure for the internet to hogans program in Crownpoint in McKinley county;

          92. five hundred thousand dollars ($500,000) to the Indian affairs department in Subsection 45 of Section 66 of Chapter 42 of Laws 2007 to plan, design, construct, equip and furnish a building to house the internet to hogans program at Navajo technical college in Crownpoint in McKinley county;

          190. one hundred thirty-eight thousand six hundred dollars ($138,600) to the local government division in Subsection 750 of Section 68 of Chapter 42 of Laws 2007 to plan, design and construct a public safety facility in Moriarty in Torrance county;

          191. one hundred seventy-five thousand dollars ($175,000) to the department of transportation in Subsection 1 of Section 61 of Chapter 92 of Laws 2008 to plan, design and construct improvements to the intersection of Arenal road SW and Atrisco road SW, including turning lanes, paving, sidewalks, curbs and acquisition of rights of way, in Bernalillo county;

          192. one hundred thirty thousand dollars ($130,000) to the department of transportation in Subsection 5 of Section 61 of Chapter 92 of Laws 2008 to plan, design and construct improvements, including paving, to Cypress road from Central avenue to the Isleta drain in Bernalillo county;

          193. one hundred seventy-five thousand dollars ($175,000) to the department of transportation in Subsection 6 of Section 61 of Chapter 92 of Laws 2008 to plan, design and construct road and drainage improvements, including additional lanes, to Eubank boulevard from Academy boulevard to Paseo del Norte in Bernalillo county;

          194. one hundred thousand dollars ($100,000) to the department of transportation in Subsection 10 of Section 75 of Chapter 42 of Laws 2007 to plan, design and construct road improvements, including widening and acquiring rights of way, to Eubank boulevard between Academy boulevard and Paseo del Norte in Bernalillo county;

          198. one hundred thousand dollars ($100,000) to the department of transportation in Subsection 16 of Section 61 of Chapter 92 of Laws 2008 to plan, design and construct improvements, including drainage, to Sunset Gardens road from Atrisco drive to the Arenal ditch, including sections of the road both inside and outside Albuquerque, in Bernalillo county;

          200. twenty-five thousand dollars ($25,000) to the department of transportation in Subsection 33 of Section 75 of Chapter 42 of Laws 2007 for landscaping and streetscaping improvements on Eighth street from Bridge boulevard to Coal avenue in the Barelas area of Albuquerque in Bernalillo county;

          231. two hundred thousand dollars ($200,000) to the department of transportation in Subsection 219 of Section 75 of Chapter 42 of Laws 2007 to plan, design and construct improvements to streets in Clayton in Union county;

          232. three hundred thousand dollars ($300,000) to the department of transportation in Subsection 189 of Section 60 of Chapter 111 of Laws 2006 to plan, design, purchase and install traffic lights on New Mexico highway 304 and 47 at Manzano expressway and Marigold boulevard in Valencia county;

          233. one hundred fifteen thousand dollars ($115,000) to the department of transportation in Subsection 228 of Section 75 of Chapter 42 of Laws 2007 to plan, design and construct improvements, including an extension, to Christopher road in Belen in Valencia county;

          234. one hundred seventy thousand dollars ($170,000) to the department of transportation in Subsection 154 of Section 61 of Chapter 92 of Laws 2008 to plan, design and reconstruct road and drainage improvements to New Mexico highway 314, including resurfacing, widening, striping, lighting, pedestrian trails and crossings, in Los Lunas and in Valencia county;

          235. six hundred twenty-five thousand dollars ($625,000) to the department of transportation in Subsection 229 of Section 75 of Chapter 42 of Laws 2007 to plan, design and construct improvements to New Mexico highway 6 in Los Lunas in Valencia county;

          236. eighty thousand dollars ($80,000) to the board of regents of eastern New Mexico university in Subsection 12 of Section 77 of Chapter 42 of Laws 2007 to purchase and install pianos for student use in the department of music at eastern New Mexico university in Portales in Roosevelt county;

          237. seven hundred thousand dollars ($700,000) to the board of regents of New Mexico highlands university in Subsection 5 of Section 78 of Chapter 42 of Laws 2007 to plan, design, construct and equip the student union and services center at New Mexico highlands university in Las Vegas in San Miguel county;

          238. four hundred thousand dollars ($400,000) originally appropriated to the local government division in Subsection 607 of Section 52 of Chapter 111 of Laws 2006 and reauthorized and reappropriated to the board of regents of New Mexico state university in Laws 2009, Chapter 128, Section 230 to plan, design, construct, equip, furnish and improve the women's soccer stadium in Las Cruces in Dona Ana county;

          239. one hundred sixty thousand dollars ($160,000) to the board of regents of New Mexico state university in Subsection 39 of Section 81 of Chapter 42 of Laws 2007 to plan, design, construct, equip and furnish the livestock research center feed mill at New Mexico state university in Clayton in Union county;

          240. three hundred five thousand dollars ($305,000) to the board of regents of northern New Mexico state school in Subsection 1 of Section 68 of Chapter 92 of Laws 2008 to acquire land for, plan, design and construct a community center campus for social service and educational programs, including site improvements, equipment and furnishings, at northern New Mexico state school in Espanola in Rio Arriba county; and

          241. one hundred thirty-five thousand dollars ($135,000) originally appropriated to the board of regents of the university of New Mexico in Subsection 3 of Section 38 of Chapter 2 of Laws 2007, of which twenty-five thousand dollars ($25,000) was reauthorized in Subsection LL of Section 99 of Chapter 42 of Laws 2007, to plan, design, construct, equip and furnish an alumni center at the university of New Mexico in Albuquerque in Bernalillo county.

     Section 2. SEVERANCE TAX BONDS--AUTHORIZATIONS--APPROPRIATION OF PROCEEDS.--

          A. The state board of finance may issue and sell severance tax bonds in compliance with the Severance Tax Bonding Act in an amount not to exceed the total of the amounts authorized for purposes specified in this act. The state board of finance shall schedule the issuance and sale of the bonds in the most expeditious and economical manner possible upon a finding by the board that the project has been developed sufficiently to justify the issuance and that the project can proceed to contract within a reasonable time. The state board of finance shall further take the appropriate steps necessary to comply with the Internal Revenue Code of 1986, as amended. Proceeds from the sale of the bonds are appropriated for the purposes specified in this act.

          B. The agencies named in this act shall certify to the state board of finance when the money from the proceeds of the severance tax bonds authorized in this section is needed for the purposes specified in the applicable section of this act. If an agency has not certified the need for the issuance of the bonds for a particular project, including projects that have been reauthorized, by the end of fiscal year 2011, the authorization for that project is void.

          C. Before an agency may certify for the issuance of severance tax bonds, the project must be developed sufficiently so that the agency reasonably expects to:

                (1) incur within six months after the applicable bonds have been issued a substantial binding obligation to a third party to expend at least five percent of the bond proceeds for the project; and

                (2) spend at least eighty-five percent of the bond proceeds within three years after the applicable bonds have been issued.

          D. Except as otherwise specifically provided by law:

                (1) the unexpended balance from the proceeds of severance tax bonds issued pursuant to this act for a project shall revert to the severance tax bonding fund no later than the following dates:

                     (a) for a project for which severance tax bonds were issued to match federal grants, six months after completion of the project;

                     (b) for a project for which severance tax bonds were issued to purchase vehicles, including emergency vehicles and other vehicles that require special equipment; heavy equipment; books; educational technology; or other equipment or furniture that is not related to a more inclusive construction or renovation project, at the end of the fiscal year two years following the fiscal year in which the severance tax bonds were issued for the purchase; and

                     (c) for any other project for which severance tax bonds were issued, within six months of completion of the project, but no later than the end of fiscal year 2013; and

                (2) all remaining balances from the proceeds of severance tax bonds issued for a project pursuant to this act shall revert to the severance tax bonding fund three months after the latest reversion date specified for that type of project in Paragraph (1) of this subsection.

          E. Except for appropriations to the capital program fund, money from severance tax bond proceeds provided pursuant to this act shall not be used to pay indirect project costs.

          F. For the purpose of this section, "unexpended balance" means the remainder of an appropriation after reserving for unpaid costs and expenses covered by binding written obligations to third parties.  

     Section 3. SEVERANCE TAX BONDS--PROVIDING FOR EXPENDITURES.--Pursuant to the provisions of Section 2 of this act, upon certification by the following agencies that the need exists for the issuance of the bonds, the following amounts are appropriated to the following agencies for the following purposes:

          1. four hundred thousand dollars ($400,000) to the aging and long-term services department to purchase and equip vehicles for senior centers nationwide on the Navajo Nation in McKinley, San Juan, Cibola, Bernalillo and Sandoval counties;

          2. one million five hundred thousand dollars ($1,500,000) to the state armory board for renovations at armory facilities statewide;

          3. four hundred thousand dollars ($400,000) to the capital program fund to plan, design, construct, renovate and equip the department of public safety district office in Albuquerque in Bernalillo county;

          4. ten thousand dollars ($10,000) to the capital program fund to plan, design and construct a safety inspection station at the Santa Teresa port of entry in Santa Teresa in Dona Ana county;

          5. one million four hundred ninety-nine thousand two hundred thirty-nine dollars ($1,499,239) to the capital program fund for construction and to equip and install a platform static scale at the Santa Teresa port of entry in Dona Ana county and to design, construct, equip and furnish a building for the border authority at the Santa Teresa border crossing in Dona Ana county;

          6. one hundred forty-six thousand nine hundred fifty-one dollars ($146,951) to the capital program fund to plan, design, construct, equip and furnish a safety inspection station in Santa Teresa in Dona Ana county;

          7. one million one hundred thousand dollars ($1,100,000) to the capital program fund to plan, design and construct a motor vehicle division field office in Santa Fe in Santa Fe county;

          8. five hundred thousand dollars ($500,000) to the capital program fund for emergency repairs to state buildings statewide;

          9. one million five hundred thousand dollars ($1,500,000) to the capital program fund to plan, design and construct improvements to state buildings statewide, including funding for contingencies;

          10. one hundred twenty-five thousand dollars ($125,000) to the cultural affairs department to plan, design and construct a retractable cover for the courtyard at the New Mexico farm and ranch heritage museum in Las Cruces in Dona Ana county;

          11. one million five hundred thousand dollars ($1,500,000) to the cultural affairs department to plan, design and construct a New Mexico archaeology center in Santa Fe county to serve as a research and collections repository for the state's archaeological collection;

          12. nine hundred thousand dollars ($900,000) to the cultural affairs department to complete construction of the center for archaeology on property donated by the United States bureau of land management in Santa Fe in Santa Fe county;

          13. fifty thousand dollars ($50,000) to the thirteenth judicial district court to purchase and install information technology, including related equipment and furniture, for the thirteenth judicial district court in Cibola county;

          14. three million five hundred thousand dollars ($3,500,000) to the economic development department to provide grants to political subdivisions of the state to achieve job growth by attracting new companies or expanding existing businesses pursuant to the Local Economic Development Act;

          15. five million dollars ($5,000,000) to the economic development department to make needed investments to stimulate economic development statewide;

          16. one million two hundred fifty thousand dollars ($1,250,000) to the economic development department to plan, design and construct the redevelopment of central business districts as part of the mainstreet program statewide;

          17. one hundred twenty-two thousand seven hundred sixty dollars ($122,760) to the public education department to design, construct and equip a facility for Media Arts Collaborative charter school in Bernalillo county;

          18. fifty thousand dollars ($50,000) to the public education department to improve the heating, ventilation and air conditioning system at A. Montoya elementary school in the Albuquerque public school district in Bernalillo county;

          19. one hundred forty-eight thousand five hundred dollars ($148,500) to the public education department to plan, design, construct, improve and equip the administrative area at Comanche elementary school in the Albuquerque public school district in Bernalillo county;

          20. eighty thousand dollars ($80,000) to the public education department to plan, design and construct a play area at Douglas MacArthur elementary school in the Albuquerque public school district in Bernalillo county;

          21. seventy-five thousand dollars ($75,000) to the public education department to make improvements to the patio at Duranes elementary school in the Albuquerque public school district in Bernalillo county;

          22. one hundred thousand dollars ($100,000) to the public education department to plan, design and construct a drop-off and pick-up area for the students at Emerson elementary school in the Albuquerque public school district in Bernalillo county;

          23. two hundred twenty-five thousand dollars ($225,000) to the public education department to plan, design and construct a playground, including purchase and installation of equipment and turf, at John Baker elementary school in the Albuquerque public school district in Bernalillo county;

          24. two hundred thousand dollars ($200,000) to the public education department to plan, design and construct a playground, including purchase and installation of equipment and turf, at John Baker elementary school in the Albuquerque public school district in Bernalillo county;

          25. one hundred thousand dollars ($100,000) to the public education department to purchase and install books and improvements at the library at La Mesa elementary school in the Albuquerque public school district in Bernalillo county;

          26. four hundred twenty-five thousand dollars ($425,000) to the public education department to purchase and install equipment and plan, design and improve the football field, including landscaping, at Manzano high school in the Albuquerque public school district in Bernalillo county;

          27. one hundred thousand dollars ($100,000) to the public education department to plan, design, construct and improve infrastructure at the field at Navajo elementary school in the Albuquerque public school district in Bernalillo county;

          28. thirty-five thousand dollars ($35,000) to the public education department to plan, design, construct and equip a facility, including site improvements, for the behavioral intervention program at Sandia high school in the Albuquerque public school district in Bernalillo county;

          29. one hundred thousand dollars ($100,000) to the public education department to plan, design, construct and improve the Valley high school soccer field in the Albuquerque public school district in Bernalillo county;

          30. one hundred twenty-five thousand dollars ($125,000) to the public education department to plan, design and construct a baseball field at Van Buren middle school in the Albuquerque public school district in Bernalillo county;

          31. one hundred fifty thousand dollars ($150,000) to the public education department to plan, design, construct and renovate the track and field facility, including bleachers, at Van Buren middle school in the Albuquerque public school district in Bernalillo county;

          32. one hundred ninety-five thousand dollars ($195,000) to the public education department to construct a school bus drop-off area at Wherry elementary school in the Albuquerque public school district in Bernalillo county;

          33. two hundred thousand dollars ($200,000) to the public education department to plan, design, construct and equip a building for the football weight room at Roswell high school in the Roswell independent school district in Chaves county;

          34. one hundred ninety-eight thousand dollars ($198,000) to the public education department to construct classrooms at Gadsden middle school in the Gadsden independent school district in Dona Ana county for use by New Mexico integrated services, the New Mexico community foundation and the department of health;

          35. three hundred seventy-five thousand dollars ($375,000) to the public education department to purchase land for, plan, design, construct and equip schools and multipurpose facilities, including a girls' softball practice field, for the Las Cruces public school district in Dona Ana county;

          36. one hundred thousand dollars ($100,000) to the public education department to plan, design, construct, purchase and install renovations to the heating, ventilation and air conditioning systems at West Las Vegas middle and Union elementary schools in the West Las Vegas public school district in San Miguel county;

          37. one hundred seventy thousand dollars ($170,000) to the public education department to plan, design and construct a roof replacement at Eldorado elementary school in the Santa Fe public school district in Santa Fe county;

          38. one hundred thousand dollars ($100,000) to the public education department to plan, design and construct a roof replacement for Gonzales elementary school in the Santa Fe public school district in Santa Fe county;

          39. one million seven hundred fifty thousand dollars ($1,750,000) to the public education department to plan, design and construct a cultural arts center at Moriarty high school in the Moriarty municipal school district in Torrance county;

          182. two hundred thirty-five thousand dollars ($235,000) to the local government division to plan, design and construct a multipurpose community center for the Santa Fe civic housing authority pursuant to the provisions of the Affordable Housing Act in Santa Fe in Santa Fe county;

          183. two hundred fifteen thousand dollars ($215,000) to the local government division to plan, design, construct, equip and furnish the Site Santa Fe museum in Santa Fe in Santa Fe county;

          184. one hundred thousand dollars ($100,000) to the local government division to plan, design and construct a cover over the municipal swimming pool in Truth or Consequences in Sierra county;

          185. one hundred seventy-three thousand two hundred fifty dollars ($173,250) to the local government division to plan, design, construct and equip the Veguita health and community center in Socorro county;

          186. two million dollars ($2,000,000) to the local government division for infrastructure improvements for colonias statewide and emergency school wastewater system improvements;

          187. eight hundred thousand dollars ($800,000) to the local government division to plan, design and construct a pediatric clinic in Taos in Taos county;

          188. one hundred eighteen thousand eight hundred dollars ($118,800) to the local government division to plan, design, construct and equip an addition to the health clinic in Estancia in Torrance county;

          189. one hundred twenty thousand dollars ($120,000) to the local government division to purchase property and to plan, design and construct a public safety facility in Moriarty in Torrance county;

          190. one hundred thirty-eight thousand six hundred dollars ($138,600) to the local government division to plan, design and construct a public safety facility in Moriarty in Torrance county;

          191. one hundred thirty thousand dollars ($130,000) to the department of transportation to plan, design and construct improvements, including paving, to Cypress road from Central avenue to the Isleta drain in Bernalillo county;

          192. one hundred seventy-five thousand dollars ($175,000) to the department of transportation to plan, design and construct road and drainage improvements, including additional lanes, to Eubank boulevard from Academy boulevard to Paseo del Norte in Bernalillo county;

          193. one hundred seventy-five thousand dollars ($175,000) to the department of transportation to plan, design and construct improvements to the intersection of Arenal road SW and Atrisco road SW, including turning lanes, paving, sidewalks, curbs and acquisition of rights of way, in Bernalillo county;

          201. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct metropolitan redevelopment in the Clayton heights and Lomas del Cielo areas, including streetscaping, lighting, land acquisition and median improvements, in Albuquerque in Bernalillo county;

          202. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct improvements to the Eldorado crossing at the intersection of Juan Tabo and Montgomery in Albuquerque in Bernalillo county;

          203. two hundred thousand dollars ($200,000) to the department of transportation to plan, design and construct sidewalk improvements in the south Broadway area of Albuquerque in Bernalillo county;

          204. two hundred forty-two thousand dollars ($242,000) to the department of transportation to plan, design and construct median landscaping on Carlisle boulevard from Candelaria road to Comanche boulevard in Albuquerque in Bernalillo county;

          205. one hundred fifty-one thousand five hundred dollars ($151,500) to the department of transportation to plan, design and construct new roadway and pedestrian improvements on Ouray road in Albuquerque in Bernalillo county;

          209. five hundred thousand dollars ($500,000) to the department of transportation to plan, design and construct roadway infrastructure improvements at the Pueblo of Laguna in Cibola county;

          210. two hundred thousand dollars ($200,000) to the department of transportation to plan, design, construct and improve bridges in Colfax county;

          217. one hundred thirty thousand dollars ($130,000) to the department of transportation to plan, design and construct landscape and streetscape improvements on Canal street in Carlsbad in Eddy county;

          218. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct road and drainage improvements to roads and streets in Hurley, including Diaz avenue and Carrasco avenue, in Grant county;

          219. one hundred seventy-five thousand dollars ($175,000) to the department of transportation to plan, design and construct improvements to county road 6 in McKinley county;

          220. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct a public access road for the Mariano Lake chapter of the Navajo Nation in McKinley county;

          221. one hundred fifty thousand dollars ($150,000) to the department of transportation to plan, design and construct improvements, including installing culverts and purchasing gravel, to road number 9653 in the Tohatchi chapter of the Navajo Nation in McKinley county;

          222. four hundred thousand dollars ($400,000) to the department of transportation to plan, design and construct improvements, including paving, to the double penetration roadway from Desert Lakes road to Martin Luther King, Jr. drive in Alamogordo in Otero county;

          223. one hundred fifty thousand dollars ($150,000) to the department of transportation to plan, design and construct a water crossing structure on county road 126 across arroyo de los Barrancos in La Mesilla in Rio Arriba county;

          224. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct improvements to series 4000 roads in San Juan county;

          225. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct improvements to series 5000 roads in San Juan county;

          226. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct improvements, including resurfacing and purchase of rights of way, to Forest Lake road in the Naschitti chapter of the Navajo Nation in San Juan county;

          227. one hundred thousand dollars ($100,000) to the department of transportation to plan, design and construct the emergency access A intersection of New Mexico highway 528 and Northern boulevard in Corrales in Sandoval county;

          228. two hundred twenty-five thousand dollars ($225,000) to the department of transportation to plan, design and construct a pedestrian walkway, including right-of-way acquisition, in Jemez Springs in Sandoval county;

          229. three hundred thousand dollars ($300,000) to the department of transportation to plan, design and construct improvements to Estes road, including the extension of the water and wastewater lines and improvements to the pedestrian walkway, in Taos in Taos county;

          230. four hundred thousand dollars ($400,000) to the department of transportation to plan, design and construct improvements to roads in Torrance county;

          231. two hundred thousand dollars ($200,000) to the department of transportation to plan, design and construct improvements to streets in Clayton in Union county;

          232. three hundred thousand dollars ($300,000) to the department of transportation to plan, design, purchase and install traffic lights on New Mexico highway 304 and 47 at Manzano expressway and Marigold boulevard in Valencia county;

          233. one hundred fifteen thousand dollars ($115,000) to the department of transportation to plan, design and construct improvements, including an extension, to Christopher road in Belen in Valencia county;

          234. one hundred seventy thousand dollars ($170,000) to the department of transportation to plan, design and reconstruct road and drainage improvements to New Mexico highway 314, including resurfacing, widening, striping, lighting, pedestrian trails and crossings, in Los Lunas and in Valencia county;

          235. six hundred twenty-five thousand dollars ($625,000) to the department of transportation to plan, design and construct improvements to New Mexico highway 6 in Los Lunas in Valencia county;

          236. eighty thousand dollars ($80,000) to the board of regents of eastern New Mexico university to purchase and install pianos for student use in the department of music at eastern New Mexico university in Portales in Roosevelt county;

          237. seven hundred thousand dollars ($700,000) to the board of regents of New Mexico highlands university to plan, design, construct and equip the student union and services center at New Mexico highlands university in Las Vegas in San Miguel county;

          238. four hundred thousand dollars ($400,000) to the board of regents of New Mexico state university to plan, design, construct, equip, furnish and improve the women's soccer stadium in Las Cruces in Dona Ana county;

          239. one hundred sixty thousand dollars ($160,000) to the board of regents of New Mexico state university to plan, design, construct, equip and furnish the livestock research center feed mill at New Mexico state university in Clayton in Union county;

          240. three hundred five thousand dollars ($305,000) to the board of regents of northern New Mexico state school to acquire land for, plan, design and construct a community center campus for social service and educational programs, including site improvements, equipment and furnishings, at northern New Mexico state school in Espanola in Rio Arriba county; and

          241. one hundred thirty-five thousand dollars ($135,000) to the board of regents of the university of New Mexico to plan, design, construct, equip and furnish an alumni center at the university of New Mexico in Albuquerque in Bernalillo county.

     Section 4. PUBLIC SCHOOL CAPITAL OUTLAY FUND--TRANSFERS TO GENERAL FUND.--

          A. Thirty-one million six hundred thousand dollars ($31,600,000) is transferred from the public school capital outlay fund to the general fund for the purpose of meeting appropriations from the general fund. The money transferred represents the remaining portion of the amount of the general fund appropriation made in Laws 2006, Chapter 111, Section 66 that has been allocated to school districts for the state share of projects pursuant to Section 22-24-5.7 NMSA 1978 but that has not yet been expended.

          B. Twenty million dollars ($20,000,000) is transferred from the public school capital outlay fund to the general fund for the purpose of meeting appropriations from the general fund. The money transferred represents the amount transferred from the general fund to the public school capital outlay fund in Subsection C of Section 12 of the General Appropriation Act of 2009.

     Section 5. SEVERANCE TAX BOND APPROPRIATIONS TO THE PUBLIC SCHOOL CAPITAL OUTLAY FUND.--Pursuant to the provisions of Section 2 of this act, upon certification by the public school capital outlay council that the need exists for the issuance of the bonds, the following amounts are appropriated to the public school capital outlay fund for the following purposes, and any unexpended or unencumbered balance shall not revert:

          A. thirty-one million six hundred thousand dollars ($31,600,000) for the purpose of meeting allocations made in Laws 2006, Chapter 111, Section 66 to school districts for the state share of the projects pursuant to Section 22-24-5.7 NMSA 1978; and

          B. twenty million dollars ($20,000,000) to carry out the purposes of the Public School Capital Outlay Act.

     Section 6. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
