AN ACT

RELATING TO LIBRARIES, MUSEUMS AND CULTURAL PROPERTIES; ESTABLISHING EXECUTIVE DIRECTOR POSITION, POWERS AND DUTIES; MAKING AN APPROPRIATION.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. Section 18-16-1 NMSA 1978 (being Laws 2009, Chapter 13, Section 1) is amended to read:

     "18-16-1. SHORT TITLE.--[This act] Chapter 18, Article 16 NMSA 1978 may be cited as the "Music Commission Act"."

     SECTION 2. A new section of the Music Commission Act is enacted to read:

     "[NEW MATERIAL] MUSIC COMMISSION EXECUTIVE DIRECTOR-- POWERS AND DUTIES.--

          A. Subject to the policies agreed to by the commission, the executive director shall:

                (1) report to the director of the division;

                (2) administer commission-funded programs as defined by Section 18-16-4 NMSA 1978;

                (3) work and collaborate with other state agencies, including the economic development department, the tourism development division of the tourism department, the public education department, the cultural affairs department and the film division of the economic development department, to assist the commission in performing its duties pursuant to Section 18-16-4 NMSA 1978;

                (4) advocate for music, music education and the economic development of music as a viable industry in the state; and

                (5) perform any other duties as directed by the commission or provided by law.

          B. The executive director shall be employed in a classified position with powers and salary commensurate with the directors of other programs advised by the division."

     SECTION 3. APPROPRIATION.--Forty thousand dollars ($40,000) is appropriated from the general fund to the cultural affairs department in fiscal year 2013 for music commission programming, services or operations. Any unexpended or unencumbered balance remaining at the end of fiscal year 2013 shall revert to the general fund.
