AN ACT

RELATING TO ELECTIONS; REQUIRING THE SECRETARY OF STATE TO PERIODICALLY CHECK THE CITIZENSHIP STATUS OF VOTERS IN THE STATE VOTER FILE.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Voter Records System Act is enacted to read:

     "[NEW MATERIAL] SECRETARY OF STATE--VOTER FILE CHECK OF CITIZENSHIP.--The secretary of state shall periodically check the state voter file database against an appropriate federal database to determine if any voter in the state voter file is a non-citizen. The secretary of state may petition the court pursuant to Section 1-4-22 NMSA 1978 to cancel the registration of a person that is registered to vote who is not a qualified elector."
