    Your HEALTH, GOVERNMENT & INDIAN AFFAIRS COMMITTEE, to whom has been referred

 

HOUSE BILL 126

 

has had it under consideration and reports same with recommendation that it DO NOT PASS, but that

 

HOUSE HEALTH, GOVERNMENT & INDIAN AFFAIRS COMMITTEE SUBSTITUTE FOR HOUSE BILL 126

 

DO PASS, amended as follows:

 

     1. On page 1, line 21, strike "8" and insert in lieu thereof "6".

 

     2. On page 5, line 14, strike "or other" and insert in lieu thereof a semicolon.

 

     3. On page 5, strike lines 15 and 16 in their entirety.

 

     4. On page 5, lines 20 through 22, strike Paragraph (3) in its entirety.

 

     5. Renumber the succeeding paragraphs accordingly.

 

     6. On page 6, lines 13 through 19, strike Subsection E in its entirety and insert in lieu thereof the following new subsection:

 

          "E. A person whose pharmacy benefits manager license has been denied, suspended or revoked may seek review of the denial, suspension or revocation pursuant to the provisions of Chapter 59A, Article 4 NMSA 1978."".

 

     7. On page 7, line 18, after "seven", insert "business".

 

     8. On page 7, lines 20 through 25, strike Paragraph (4) in its entirety.

 

     9. Renumber the succeeding paragraphs accordingly.

 

     10. On page 9, lines 16 through 19, strike Subsection D in its entirety and insert in lieu thereof a closing quotation mark.

 

     11. On pages 9 through 11, strike Sections 6 through 8 in their entirety and insert in lieu thereof the following new section:

 

     "SECTION 6. A new section of the New Mexico Insurance Code is enacted to read:

 

     "[NEW MATERIAL] AUDIT--PHARMACY BENEFITS MANAGER.--A pharmacy benefits manager, whether licensed pursuant to the Pharmacy Benefits Manager Regulation Act or exempt from licensure pursuant to that act, shall be subject to Section 61-11-18.2 NMSA 1978 to the same extent and in the same manner as a pharmacy."".

 

     12. Renumber the succeeding section accordingly.,

 

and thence referred to the JUDICIARY COMMITTEE.
