AN ACT

RELATING TO HEALTH; ENACTING A NEW SECTION OF THE LYNN AND ERIN COMPASSIONATE USE ACT TO ESTABLISH MEDICAL CANNABIS POSSESSION LIMITS FOR CERTAIN LICENSED PRODUCERS AND ESTABLISH A LICENSURE FEE LIMIT FOR LICENSED PRODUCERS.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. A new section of the Lynn and Erin Compassionate Use Act is enacted to read:

     "[NEW MATERIAL] LICENSED PRODUCERS--PLANT POSSESSION LIMITATION--FEE.--

          A. On an annual basis and in accordance with department rules, an applicant for licensure shall submit an application for licensure or renewal of licensure. The application shall include a production plan that specifies the number of plants the applicant intends to possess during the upcoming fiscal year.

          B. The department shall limit the number of plants that a licensed producer, who is not a qualified patient producing for the patient's own personal use, may possess to a number that is equal to fifteen percent of qualified patients statewide at the time the licensed producer, or applicant for licensure, submits an application for licensure in accordance with the provisions of Subsection A of this section.

          C. The department shall assess a licensed producer:

                (1) who is a qualified patient applying for a license for personal production an annual license fee that shall not exceed a total of thirty dollars ($30.00); and

                (2) that is any other type of licensed producer an annual license fee that shall not exceed two hundred dollars ($200) per plant."
