Mr. President:
Your JUDICIARY COMMITTEE, to whom has been referred
SENATE BILL 137
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 6, line 20, after "Assets", insert "Managed by a Fiduciary".
2. On page 7, strike lines 11 through 14 in their entirety and insert in lieu thereof:
"More than $1,000,000,000 but not
more than $2,000,000,000 $6,000,000
More than $2,000,000,000 $6,000,000 plus
$1,000,000 for every
$1,000,000,000 over
$2,000,000,000.".
3. On page 15, between lines 14 and 15, insert the following new section to read:
"SECTION 8. A new section of the Trust Company Act is enacted to read:
"[NEW MATERIAL] APPEALS.--
A. A person aggrieved by a final order of the director may appeal to the district court pursuant to the provisions of Section 39-3-1.1 NMSA 1978.
B. The commencement of proceedings pursuant to Subsection A of this section does not, unless specifically ordered by the court, operate as a stay of the director's order."".
4. Renumber the succeeding sections accordingly.
