    Your FINANCE COMMITTEE, to whom has been referred


     HOUSE TAXATION & REVENUE COMMITTEE SUBSTITUTE FOR HOUSE BILL 11


has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:


    1. On page 1, line 13, after the semicolon, strike the remainder of the line, strike lines 14 and 15 in their entirety and strike line 16 through the semicolon.


    2. On page 2, line 12, strike "minimum" and insert in lieu thereof "baseline".


    3. On page 6, between lines 5 and 6, insert the following:

"(b) the placement of new broadband telecommunications network facilities; provided that the facilities shall not serve a public facility or location that already meets federal communications commission baseline speed standards;".


    4. Reletter the succeeding subparagraphs accordingly.


    5. On page 21, line 7, strike the subsection designation "A.".


    6. On page 21, line 22, after the period, insert a closing quotation mark, strike lines 23 through 25 in their entirety and on page 22, strike lines 1 through 13 in their entirety.


    7. On pages 22 through 26, strike Section 10 in its entirety.


    8. On page 26, line 21, strike "years 2020 through 2022" and insert in lieu thereof "year 2020 and subsequent taxable years in which a recovery entity applies for a recovery grant".



    9. On page 26, line 23, strike "from" and insert in lieu thereof "between comparable quarters in".


    10. On page 27, line 1, after "authority", strike the remainder of the line and strike lines 2 through 8 in their entirety and insert in lieu thereof:


"may designate one or more application periods and shall review applications received in each period and provide a determination to the applicant within a reasonable amount of time after review. The first application period shall accept applications no later than June 30, 2021, and the last application period shall accept applications no later than December 31, 2021; provided that an application period for funds set aside pursuant to Subsection E of this section shall accept applications no later than June 30, 2022. The authority shall prioritize funding to applicants that had the greatest decline in business revenues between comparable quarters in taxable year 2019 to taxable year 2020.".


    11. On page 29, line 17, after "open", strike the remainder of the line, strike line 18 up to the comma and insert in lieu thereof "and can demonstrate a net increase in the number of full-time-equivalent employees relative to the immediately preceding quarter".


    12. On page 30, line 4, strike "2021 act" and insert in lieu thereof "section".


    13. On page 30, line 15, strike "15" and insert in lieu thereof "11".


    14. On page 30, strike lines 16 through 24 in their entirety and insert in lieu thereof the following:


         "F. If a recovery entity loses eligibility in a quarter, the authority shall set aside funds for the recovery entity to access should the recovery entity become eligible again in a succeeding quarter.".


    15. On page 32, line 11, strike "and", on line 13, after the semicolon, insert "and" and between lines 13 and 14, insert the following:


                  "(c) experienced a decline in business revenue between one or more comparable quarters in taxable years 2019 and 2020, as determined by the economic development department and the authority based on documentation provided by the business;".


    16. On pages 32 through 35, strike Sections 12 through 14 in their entirety.

 

    17. On page 36, line 4, strike "11" and insert in lieu thereof "10".


    18. On page 36, line 8, strike "10 and 12 through 14" and insert in lieu thereof "9".


    19. Renumber sections in accordance with these amendments.
