AN ACT

MAKING AN APPROPRIATION FROM FEDERAL FUNDS TRANSFERRED TO THE APPROPRIATION CONTINGENCY FUND TO THE DEPARTMENT OF TRANSPORTATION FOR INFRASTRUCTURE PROJECTS ON A CERTAIN PORTION OF UNITED STATES HIGHWAY 380.

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

     SECTION 1. APPROPRIATION.--Forty-six million dollars ($46,000,000) is appropriated from the appropriation contingency fund, from funds allocated to the state pursuant to the federal American Rescue Plan Act of 2021 and transferred to the appropriation contingency fund during the second special session of the fifty-fifth legislature, to the department of transportation for expenditure in fiscal years 2022 through 2025 for acquisition of rights of way, planning, design and construction and to match federal and other state funds for infrastructure projects on United States highway 380 from milepost 158 in Chaves county to the Texas state line. Any unexpended or unencumbered balance remaining at the end of fiscal year 2025 shall revert to the appropriation contingency fund.
