A RESOLUTION

AMENDING THE SENATE RULES REGARDING CORONAVIRUS DISEASE 2019 PROTOCOLS.

 

     WHEREAS, Senate Rule 24-1 provides that the rules of the senate may be amended by a two-thirds' vote of all the members of the senate or by a majority vote of the members of the senate upon the recommendation of the senate rules committee;

     NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that Senate Rule 7-1-3, effective for any sessions of the fifty-fifth legislature held in 2021, be amended to read:

"7-1-3    A senator who has tested positive for severe acute respiratory syndrome coronavirus 2 within ten days before or during a session or who has actual knowledge of a person who has tested positive for severe acute respiratory syndrome coronavirus 2 with whom the senator has been in close contact, as defined by the New Mexico department of health, during that time shall inform the senator's respective floor leader or whip. For floor sessions:

(a) a senator who has been in close contact with an individual who has tested positive for severe acute respiratory syndrome coronavirus 2 in the past fourteen days, and who has been fully vaccinated against severe acute respiratory syndrome coronavirus 2, may continue to remain physically present in the state capitol upon producing a negative test for severe acute respiratory syndrome coronavirus 2; and

(b) a senator who has tested positive for severe acute respiratory syndrome coronavirus 2 or has come into close contact with an individual who has tested positive for severe acute respiratory syndrome coronavirus 2 in the past fourteen days, and who has not been fully vaccinated, shall either be excused or shall self-isolate outside the capitol in the city of Santa Fe and participate by simultaneous, remote electronic means and be visually present or, if participating by telephone, confirm the senator's presence by voice. A senator who is self-isolating shall continue in self-isolation until advised by a medical professional that self-isolation is no longer necessary.".
