A MEMORIAL

REQUESTING THE PUBLIC REGULATION COMMISSION TO CONVENE A WORKING GROUP TO DEVELOP RECOMMENDATIONS FOR A REGULATORY AND STATUTORY FRAMEWORK THAT WOULD PROMOTE RELIABLE AND CONSISTENT ACCESS TO UTILITIES FOR TENANTS RESIDING IN MOBILE HOME PARKS.

 

     WHEREAS, mobile homes make up roughly one-sixth of all houses in New Mexico; and

     WHEREAS, a significant portion of mobile homes in the state are located within mobile home parks; and

     WHEREAS, mobile home park residents often own a mobile home while renting the land the home occupies from the mobile home park owner; and

     WHEREAS, the owner of a mobile home park is responsible for providing utilities, including water, electricity, gas and sewer, to a tenant's mobile home; and

     WHEREAS, many mobile home park tenants have experienced frequent and lengthy interruptions in access to utilities; and

     WHEREAS, there are currently few remedies for mobile home park tenants who have limited or nonexistent access to utilities; and

     WHEREAS, the various utilities that serve mobile home parks and mobile home park tenants are often under vastly different regulatory schemes, with varying levels of oversight from varying regulatory entities; and

     WHEREAS, improved oversight and regulation are needed to promote fair access to utilities in mobile home parks;

     NOW, THEREFORE, BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF NEW MEXICO that the public regulation commission be requested to convene a working group to develop recommendations for a regulatory and statutory framework that would promote reliable and consistent access to utilities for tenants residing in mobile home parks; and

     BE IT FURTHER RESOLVED that the working group be requested to be composed of a diverse group of stakeholders that includes:

          A. representatives from the public regulation commission;

          B. the superintendent of regulation and licensing, or the superintendent's designee;

          C. the attorney general, or the attorney general's designee;

          D. a representative from an association that represents mobile home park owners;

          E. a representative from an association that represents mobile home park tenants;

          F. a representative from a municipal utility; and

          G. a representative from a group that advocates for low-income persons; and

     BE IT FURTHER RESOLVED that the working group be requested to report its findings, conclusions and recommendations to the appropriate interim legislative committees that study housing and property issues by November 1, 2026; and

     BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the superintendent of regulation and licensing, the chair of the public regulation commission and the attorney general.
