RE: Summary of Public School-Related Legislation Passed by the Forty-Fifth Legislature, Second Session, 2002 (After Executive Action)

Enclosed for your information are updates to the February 20, 2002 memorandum summarizing public school-related legislation passed by the 2002 Legislature. These materials reflect final action by the Governor.

The 2002 Legislature passed two versions of the General Appropriation Act of 2002 that provided FY 03 public school funding, but Governor Johnson vetoed both (refer to Tables 1 and 2). On February 7, 2002, the Governor vetoed CS/HB 2, et al., stating that the bill did not provide for a flat budget, adequate reserves for our future, or responsible Medicaid spending. On March 6, 2002, he vetoed CS/SB 1. In his veto message, the Governor reiterated the concerns he had expressed earlier. In his partial veto message of *CS/H 88, as amended, Governor Johnson concluded, AChoices have been made. Laws have been signed or vetoed. The 45th Legislature is officially over pursuant to the Constitution. I will now take all necessary and appropriate executive action to manage the government over the remainder of my term in office."

STATE DEPARTMENT OF PUBLIC EDUCATION:

The general fund appropriation to the state department of public education in the personal services and employee benefits category includes sufficient funds for two permanent FTE for the agriculture program located in Las Cruces.

The state board of education is directed to evaluate funds appropriated to New Mexico under the 2001 reauthorization of the federal Elementary and Secondary Education Act, ANo Child Left Behind@, to determine how the federal initiatives align with legislative initiatives and identify how those federal funds can be used in conjunction with state funds to enhance state appropriations for the state department of education and public school support. The state board of education shall report to the legislative finance committee and the legislative education study committee by May 1, 2002.

Unexpended or unencumbered balances in the state department of public education remaining at the end of fiscal year 2003 from appropriations made from the general fund shall revert.

Except as otherwise provided, balances of appropriations made in this subsection shall not revert at the end of fiscal year 2003.

The general fund appropriation for the state equalization guarantee distribution contains sufficient funds to offset the estimated increases in medical insurance premiums incurred in fiscal year 2003 by public school employees, including public school transportation employees.

The rate of distribution of the state equalization guarantee distribution shall be based on a program unit value determined by the superintendent of public instruction. The superintendent of public instruction shall establish a preliminary unit value to establish budgets for the 2002-2003 school year; and then upon verification of the number of units statewide for fiscal year 2003 but no later than January 31, the superintendent of public instruction may adjust the program unit value.

For the 2002-2003 school year, the state equalization guarantee contains sufficient funding for districts implementing a formula-based program for the first time. Those districts shall use current year MEM in the calculation of program units for the new formula-based program.

*H 18 SCHOOL DISTRICT BOND ANTICIPATION NOTES ACT, SGND (Mar. 4) Ch. 54, Burpo — creates the School District Bond Anticipation Notes Act; provides a mechanism for school districts to obtain short-term financing for capital projects that are needed to meet the educational needs of students in school districts; and provides an alternative method to obtain funding for capital projects by school districts.

CS/H 28a INDIAN EDUCATION ACT, VETO (Mar. 5), Begaye — creates the Indian Education Act and the Indian and Higher Education Fund to ensure equitable educational opportunities for American Indian students enrolled in New Mexico public schools; creates a new Indian Education Division at SDE and an advisory council to provide assistance to school districts and tribes; sets out duties for the Indian Education Division; appropriates $400,000 from SDE cash balances and $250,000 from the General Fund to the Indian and Higher Education Fund for FY 03 and FY 04 to carry out the provisions of the Indian Education Act; and repeals the existing Indian Education Division in the Public School Code. H 44 INCREASE PER DIEM RATE, VETO (Mar. 6, Varela — increases reimbursement rates for per diem and mileage expenses of salaried and nonsalaried public officials and employees effective July 1, 2002.

*CS/H 89a 2002 CAPITAL PROJECTS GO BOND ACT, SGND (Mar. 5) Ch. 93, Sandoval — authorizes the sale of General Obligation Bonds for statewide capital outlay projects; among its provisions, includes a total of $5.0 million to SDE to purchase portable classrooms or build classrooms for full-day kindergarten throughout the state; $7.7 million to the Office of Cultural Affairs for public school libraries; and requires voter approval.

ELECTRIC GENERATION FACILITIES TAX INCENTIVES, SGND (Mar. 4) CH. 37, Gubbels — among its provisions, amends the Industrial Revenue Bond Act to prohibit a municipality from acquiring any electrical generation facility project without the approval of the local school board of the school district in which the project is located and without determining the amount of an annual in-lieu tax payment to be made to the school district by the person proposing the project. H 153a REDISTRICTING OF SCHOOL DISTRICTS, VETO (Mar. 5), Taylor,JG —amends the Public School Code to require a school district with a membership greater than 35,000 students to prepare a redistricting plan to be submitted to voters of the school district for approval or rejection; creates an SBE-appointed task force to assist the district with its redistricting plan; requires the district to hold a special election by February 2004 regarding the division of the district; and appropriates $80,000 from the General Fund to SDE for FY 03 through FY 05 to assist in redistricting.

CS/H 165 TRIBAL CAPITAL IMPROVEMENTS TAX CREDIT, SGND (Mar. 4) Ch. 15, Lujan — creates the Jicarilla Apache Tribal Capital Improvements Tax Credit for people who are liable for the payment of the oil and gas emergency school tax imposed on the privilege of severing products from Jicarilla Apache tribal land.

H 170a PRESCRIPTIVE AUTHORITY TO PSYCHOLOGISTS, SGND (Mar. 5) Ch. 100, Sandoval — amends the New Mexico Drug, Device and Cosmetic Act to grant prescriptive authority to licensed psychologists who hold valid prescription certificates. (Applies to licensed public school psychologists.)

H 171a UNM TAOS BRANCH COMMUNITY COLLEGE, SGND (Mar. 5) Ch. 73, Gonzales — creates the Taos Branch Community College of the University of New Mexico (UNM) on July 1, 2003.

H 200a SENIOR PRESCRIPTION DRUG PROGRAM, SGND (Mar. 5) Ch. 75, Picraux — creates the Senior Prescription Drug Program and Fund to be administered by the Retiree Health Care Authority in conjunction with or through the consolidated purchasing process pursuant to the Health Care Purchasing Act. H 204 NATIVE AMERICAN LANGUAGE TEACHER CERTIFICATE, SGND (Mar. 4) Ch. 41, Garcia,MH — authorizes SBE to issue a certificate to non-degreed individuals who are qualified to teach Native American languages and who meet approved SBE teaching competencies. (For the LESC) (Identical to S 126)

H 307 COUNTY LEARNING CENTER DISTRICTS, SGND (Mar. 4) Ch. 19, Irwin — amends the Learning Center Act to allow boards of county commissioners to establish learning center districts with the approval of each community college board or local school board located wholly or partially within the county.

H 311a DEVELOP CLASSIFIED STAFF T&E INDEX, VETO (Mar. 5), Garcia,MH — requires SDE to study the feasibility of developing a Training and Experience Index for personnel who are not assigned to an instructional program of a school district and to report its findings to the LESC and the LFC by November 1, 2002.

FL/H 359 TEACHER HOUSING REVENUE BOND ACT, SGND (Mar. 4) Ch. 22, Lundstrom — creates the Teacher Housing Revenue Bond Act to allow local school boards to issue bonds to finance teacher housing projects; allows federal funds to be pledged for teacher housing even if subject to annual appropriation; and establishes a debt service fund for the payment of principal, interest, and service charges on teacher housing revenue bonds.

 

HOUSE JOINT MEMORIALS

HJM 10a MINOR IN TEACHING OF READING REQUIREMENT, Stewart — requests SDE, in collaboration with CHE, to study the feasibility of instituting a minor in the teaching of reading as a requirement for granting teacher certification in elementary education; and that SDE report to the LESC by August 2002. HJM 83 INTERAGENCY COMMITTEE ON LONG-TERM CARE, Taylor,JP — requests that the Interagency Committee on Long-Term Care consider increasing its membership to include representation from the community of low-income, disabled consumers and various disabilities advocacy organizations as well as the New Mexico Mortgage Finance Authority, the State Highway and Transportation Department, and Department of Finance and Administration (DFA) and requests that the committee expand its purpose to address compliance with the Olmstead decision, a U.S. Supreme Court decision that provides the legal framework to enable people with disabilities to live in the most integrated setting appropriate to their individual needs. CS/S 1 GENERAL APPROPRIATION ACT OF 2002, VETO (Mar. 6), Altamirano — makes general appropriations from the General Fund and authorizes expenditures by agencies, among its provisions, appropriates $1.8 billion for public school support and education-related appropriations for public school districts in FY 03; public school support appropriations include the State Equalization Guarantee, Public School Transportation, the Instructional Material Fund, the Educational Technology Fund, the Incentives for School Improvement Fund, and the Reading Proficiency Fund; related appropriations include funding for Beginning Teacher Induction and Mentorship, the Charter Schools Stimulus Fund, Performance-Based Budgeting, and Re: Learning.

S 18a ALTERNATIVE FUEL VEHICLE ACQUISITIONS, SGND (Mar. 4) Ch. 32, Feldman — amends the Alternative Fuel Conversion Act by renaming it as the Alternative Fuel Acquisition Act; requires state educational institutions, under the administration of CHE and SDE, to acquire vehicles capable of operating on alternative fuel; and requires educational institutions to report yearly to the Energy, Minerals and Natural Resources Department the total number of vehicles acquired in the preceding fiscal year and the number of those vehicles that are capable of operating on alternative fuel or that are gas-electric hybrid vehicles, effective July 1, 2002.

*S 51a NMFA PUBLIC PROJECTS, SGND (Mar. 4) Ch. 67, Campos — among its provisions, allows loans to be made from the Public Project Revolving Fund to the Los Alamos school district for technology equipment; Pojoaque Valley Public Schools for a wastewater and water project, and building projects; Rio Rancho Public Schools to construct a building; Dexter Consolidated Schools, Hagerman Municipal Schools, Hatch Valley Public Schools, Peñasco Independent Schools, Questa Independent Schools, Taos Municipal Schools, Texico Municipal Schools, and T or C Municipal Schools for building projects; and Gallup-McKinley County Public Schools for teacher housing projects and building projects.

S 61a CHANGE AT-RISK INDEX CALCULATION, SGND (Mar. 4) Ch. 68, Altamirano — amends the Public School Finance Act to change the calculation of the at-risk index used to determine additional program units based on a three-year average rate of three student variables (Title I eligible, limited English proficient, and mobility); recalculates the index every year; and holds districts harmless for three years beginning school year 2002-2003 at no less than 90 percent of the at-risk funding generated in school year 2000-2001.

S 91a SENIOR PRESCRIPTION DRUG BENEFIT, SGND (Mar. 5) Ch. 76, Feldman — creates the Senior Prescription Drug Program and Fund to be administered by the Retiree Health Care in conjunction with or through the consolidated purchasing process pursuant to the Health Care Purchasing Act. S 92a ENROLLMENT GROWTH PROGRAM UNITS CALCULATION, VETO (Mar. 5), Carraro — contingent upon certification by the Superintendent of Public Instruction that the 2003 Legislature has appropriated sufficient additional funds to fund the increase in enrollment growth program units for school districts in the 2003-2004 school year, amends the Public School Finance Act to change the calculation for determining enrollment growth program units based on a .50 unit for any increases in student enrollment and on the average unit value of a student on the 40th day of the current year for school districts with growth above one percent.

S 126 NATIVE AMERICAN LANGUAGE TEACHER CERTIFICATE, SGND (Mar. 5) Ch. 81, Tsosie — amends the Public School Code to authorize SBE to issue a certificate to non-degreed individuals who are qualified to teach Native American languages and cultures and who meet approved SBE teaching competencies. S 198a INDIAN EDUCATION ACT, VETO (Mar. 5), Tsosie — creates the Indian Education Act and the Indian and Higher Education Fund to ensure equitable educational opportunities for American Indian students enrolled in New Mexico public schools; creates a new Indian Education Division at SDE and an advisory council to provide assistance to school districts and tribes; sets out duties for the Indian Education Division; appropriates $400,000 from SDE cash balances to the Indian and Higher Education Fund for FY 03 and FY 04 to carry out the provisions of the Indian Education Act; and repeals the existing Indian Education Division in the Public School Code. (Similar to H 28)

S 205 CHANGE PROGRAM UNIT CALCULATION, SGND (Mar. 4) Ch. 63, Nava — amends the Public School Finance Act to require that program units for a school district with a basic program MEM of 200 or less be based on the average MEM of the 40th, 80th, and 120th days of the prior year or on the 40th day of the current year, whichever is greater. *S 256a INSURANCE FORMS EXEMPTION, SGND (Mar. 4) Ch. 64, Leavell — amends the New Mexico Insurance Code to provide for an exemption from the requirement that certain forms and classifications be filed with and approved by the Superintendent of Insurance. (May affect public schools.)

*S 280 STPF INVESTMENT IN NM FILM PROJECTS, SGND (Mar. 4) Ch. 60, Robinson — amends current law to allow direct investment of the Severance Tax Permanent Fund in New Mexico film projects, under certain provisions and with limitations. (May affect public schools.)

S 286a PUBLIC SCHOOL CAPITAL OUTLAY EXPENSES, SGND (Mar. 4) Ch. 65, Nava — amends the Public School Capital Outlay Act to allow the Public School Capital Outlay Council to expend no more than three percent for project management expenses from the proceeds of the Supplemental Severance Tax Bond, the Severance Tax Bond and General Fund appropriations to the Public School Capital Outlay Fund in Chapter 338 of Laws 2001 for the purpose of correcting outstanding deficiencies and $1.1 million for the core administrative functions of the Deficiencies Correction Unit from the General Fund appropriation in Chapter 338 of Laws 2001.

CS/S 358a CAPITAL OUTLAY PROJECTS, SGND (Mar. 5) Ch. 99, Fidel — among its provisions, reauthorizes a 2000 Second Special Session severance tax bond authorization of $50,000 and a General Fund appropriation of $75,000 to change the purpose from construction of an alternative school in the Clayton Public Schools to purchasing equipment.

*S 379a INTERIM LEGISLATIVE MEDICAID REFORM COMMITTEE, SGND (Mar. 5) Ch. 96, Ingle — creates the Interim Medicaid Reform Committee (IMRC) to examine the statutes, constitutional provisions, regulations, and court decisions governing the state’s Medicaid program and related health care programs and services; requires the IMRC to recommend legislation or changes to the Medicaid program for consideration by the Legislature; and appropriates $400,000 from the General Fund to the Legislative Council Service for FY 03 and FY 04.
