AN ACT

MAKING AN APPROPRIATION TO THE DEPARTMENT OF FINANCE AND ADMINISTRATION FOR A PERFORMANCE AND MANAGEMENT AUDIT OF THE STATE DEPARTMENT OF PUBLIC EDUCATION; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal years 2000 and 2001 to contract for a performance and management audit of the entire state department of public education. The performance and management audit shall consist of the organization, management and governance practices of the department; the financial development process and budget management practices; centralized and decentralized delivery of department services; uses of technology; management of human resources functions; and the involvement of various stakeholder groups, including an assessment of satisfaction levels. The department of finance and administration shall report the results of the audit to the governor, legislature and state board of education by December 1, 2000. Any unexpended or unencumbered balance remaining at the end of fiscal year 2001 shall revert to the general fund.

Section 2. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
