AN ACT

RELATING TO CORRECTIONAL FACILITIES; PROVIDING FOR AN ADULT MALE IN-PRISON SUBSTANCE ABUSE TREATMENT FACILITY AND AN ADULT FEMALE REINTEGRATION FACILITY; MAKING AN APPROPRIATION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. CORRECTIONAL FACILITIES--APPROPRIATIONS--CONDITIONS.--

A. One million six hundred fifty thousand dollars ($1,650,000) is appropriated from the general fund to the corrections department as the state match with fourteen million eight hundred fifty thousand dollars ($14,850,000) from the federal violent offender incarceration grants fund for expenditure in fiscal year 2001 for the purpose of acquiring a four-hundred bed adult male in-prison substance abuse treatment facility located in the middle Rio Grande corridor. Any unexpended or unencumbered balance of the general fund appropriation remaining at the end of fiscal year 2001 shall revert to the general fund.

B. Three million dollars ($3,000,000) is appropriated from the general fund to the corrections department for expenditure in fiscal year 2001 for the purpose of acquiring a two-hundred-fifty bed adult female reintegration facility adjacent to the facility to be acquired pursuant to Subsection A of this section. Any unexpended or unencumbered balance remaining at the end of fiscal year 2001 shall revert to the general fund.

C. No contract for the acquisition of a facility shall be entered into pursuant to Subsection A or B of this section unless the secretary of corrections certifies that the facility will be built by a primary contractor and subcontractors that:

(1) maintain their primary places of business in New Mexico;

(2) hire laborers for construction of the facility as employees, rather than as independent contractors, and who are New Mexico residents;

(3) provide health care benefits, retirement benefits and unemployment insurance to their employees working on construction of the facility; and

(4) maintain apprenticeship programs for their employees.
