Synopsis of HGUAC Amendment

The House Government and Urban Affairs Committee amends House Bill 427. The amendment changes the agency that the appropriation is provided for, and does not change the original intent of the legislation.

Synopsis of Bill

House Bill 427 appropriates $50.0 from the general fund to CYFD to develop an information process, develop provisions and complete inter-governmental agreements between CYFD and Tribes interested in entering into agreements with the State.

Significant Issues

The bill intent is related to provisions under the Children's Code, Chapter 32 A -1-8 NMSA 1978. This chapter deals with the jurisdiction of the state court and tribal court.

FISCAL IMPLICATIONS

House bill 427 appropriates $50.0 from the general fund and is recurring.

ADMINISTRATIVE IMPLICATIONS

OTHER SUBSTANTIVE ISSUES

Under Chapter 32A-1-8 item E, states " A tribal court order pertaining to an Indian child that accesses state resources shall be recognized and enforced pursuant to the provisions of intergovernmental agreements entered into by the Indian's tribe and the department or another state agency. An Indian child residing on or off a reservation, as a citizen of this state, shall have the same right to services that are available to other children of the state ,pursuant to intergovernmental agreements."
