A JOINT MEMORIAL

REQUESTING THE EDUCATIONAL RETIREMENT BOARD AND THE LEGISLATIVE EDUCATION STUDY COMMITTEE TO STUDY THE TRANSFER OF SICK LEAVE BENEFITS AND THE USE OF LEAVE BENEFITS TO CALCULATE RETIREMENT CREDITS.



WHEREAS, education employees accumulate sick leave benefits on a regular basis, and

WHEREAS, education employees are encouraged to conserve their sick leave benefits for necessary occasions; and

WHEREAS, while many education employees who conserve their sick leave benefits find the benefits are used as intended, there are also many employees who find themselves without need of the sick leave benefits; and

WHEREAS, education employees do not receive a benefit from conserving their unused sick leave; and

WHEREAS, allowing education employees to transfer their accumulated sick leave benefits upon moving to other public employment will likely serve as an incentive to conserve sick leave benefits; and

WHEREAS, giving retirement credit for unused sick leave will likely provide a benefit to education employees and also serve as an incentive to conserve sick leave benefits;

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that education employees should benefit from conserving sick leave; and

BE IT FURTHER RESOLVED that the educational retirement board and the legislative education study committee be requested to jointly study the ability for education employees to transfer accumulated sick leave benefits upon moving to another public employment position; and

BE IT FURTHER RESOLVED that the educational retirement board and the legislative education study committee be requested to jointly study the use of accumulated sick leave as retirement credits; and

BE IT FURTHER RESOLVED that following their study, if necessary, the educational retirement board and the legislative education study committee be requested to recommend legislation to the 2001 legislature; and

BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the director of the educational retirement board and the chairman of the legislative education study committee.
