REQUESTING THE DEPARTMENT OF HEALTH, THE BOARD OF PHARMACY AND THE ATTORNEY GENERAL TO INVESTIGATE ACTIVITIES OF WYETH HOME PRODUCTS IN THEIR FAILURE TO WARN NEW MEXICANS OF THE DANGERS OF THEIR DIET DRUGS FEN-PHEN/REDUX.

WHEREAS, an estimated twenty-five thousand New Mexicans and six million Americans took the drugs Fen-Phen/Redux; and

WHEREAS, these diet drugs have been found to cause heart damage and other injuries, and New Mexicans were not warned of the dangers of the drugs; and

WHEREAS, New Mexico has an interest in preserving the safety, health and welfare of its citizens;

NOW, THEREFORE, BE IT RESOLVED BY THE SENATE OF THE STATE OF NEW MEXICO that the department of health, the board of pharmacy and the attorney general be requested to investigate the activities of Wyeth home products in its failure to warn New Mexicans of the dangers of these drugs; and

BE IT FURTHER RESOLVED that all individuals who may have been harmed by the use of these drugs be urged to take action to protect their interest in the four billion dollar ($4,000,000,000) diet drug class action settlement by the March 30, 2000 deadline; and

BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the department of health, the board of pharmacy and the attorney general.
