A JOINT MEMORIAL

DIRECTING THE LEGISLATIVE COUNCIL SERVICE TO WORK WITH THE LEGISLATIVE FINANCE COMMITTEE TO STUDY AND REPORT RECOMMENDATIONS ON PROPOSED PRIVATIZATION OF STATE SERVICES AND FUNCTIONS.



WHEREAS, decisions to privatize state services and functions should be taken very seriously to ensure cost savings and an improved delivery of services; and

WHEREAS, privatization should not replace infrastructure that already delivers services cost-effectively; and

WHEREAS, the procurement and contracting process by which privatization of services and functions occurs should be reviewed and must be open to legislative oversight;

NOW, THEREFORE, BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO that the legislative council service be directed to study and report recommendations on proposed privatization of state services and functions; and

BE IT FURTHER RESOLVED that the legislative council service include the effect of privatization on employment opportunities and state liability issues, the advisability of prior legislative approval and guidelines on who shall make public policy and conduct planning related to privatization of state services and functions in its study; and

BE IT FURTHER RESOLVED that the legislative council service work with the legislative finance committee to include in its report a cost-benefit analysis of existing state services and functions that are privatized and the effect of privatization on existing infrastructure; and

BE IT FURTHER RESOLVED that state department and agency secretaries and other parties be requested to cooperate with the legislative council service review of privatization of state services and functions and make all information available to the legislative council service regarding this topic; and

BE IT FURTHER RESOLVED that the legislative council service report its findings and recommendations to the New Mexico legislative council and the legislative finance committee before the first session of the forty-fifth legislature; and

BE IT FURTHER RESOLVED that copies of this memorial be transmitted to the co-chairs of the New Mexico legislative council and the chair of the legislative finance committee and their respective staff directors.
