SENATE EXECUTIVE MESSAGE NO. 57

Honorable President and Members of the Senate:

 

I have this day VETOED and am returning SENATE BILL 375, as amended, enacted by the Forty-Fifth Legislature, First Session, 2001.

 

This bill would amend the Comprehensive Health Insurance Pool Act by broadening the authority of the board of directors to make assessments and set premiums, and define certain actions as unfair trade practices. However, the expanded authority granted to the board of directors would allow interim assessments that could include anticipated expenses for the following year. Unfortunately, this provision creates a solvency-reporting problem with the division of insurance. For these reasons it would be unwise to adopt this legislation in its present form.
