AN ACT

MAKING AN APPROPRIATION TO DEVELOP THE SOUTHWEST REGIONAL SPACEPORT.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--One million five hundred thousand dollars ($1,500,000) is appropriated from the general fund to the space commercialization division of the economic development department for expenditure in fiscal years 2002 through 2004 to develop the southwest regional spaceport, including conducting environmental impact studies, acquiring land and water and developing a proposal in response to Lockheed Martin's venturestar or similar reusable launch vehicle or other launch system developer site selection process. Expenditure of the money shall be contingent on a written commitment that New Mexico is one of three competing sites for the Lockheed Martin venturestar, a similar reusable launch vehicle or other launch system developer. Any unexpended or unencumbered balance remaining at the end of fiscal year 2004 shall revert to the general fund.
