Mr. Speaker:

Your AGRICULTURE AND WATER RESOURCES COMMITTEE, to whom has been referred

HOUSE BILL 445

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 2, lines 10 and 11, strike "a suspension or revocation" and insert in lieu thereof "an order to cease the violation".

2. On page 2, line 23, strike "unless" and insert in lieu thereof "after".

3. On page 2, between lines 24 and 25, insert:

"(1) has been given the opportunity to contest informally the alleged violation with the office of the state engineer and declines within thirty days a public hearing pursuant to Sections 72-2-16 and 72-2-17 NMSA 1978;".

4. Renumber the succeeding paragraphs accordingly.

5. On page 3, line 7, after the period insert the subsection designation "E.".

6. Reletter the succeeding subsection accordingly.,

and thence referred to the JUDICIARY COMMITTEE.
