AN ACT

RELATING TO THE LEGISLATIVE BRANCH OF GOVERNMENT; PROVIDING A SALARY FOR LEGISLATORS CONTINGENT UPON THE ADOPTION BY THE PEOPLE OF AN AMENDMENT TO THE CONSTITUTION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 2-1-8 NMSA 1978 (being Laws 1955, Chapter 2, Section 1, as amended) is amended to read:

"2-1-8. SESSION PER DIEM AND MILEAGE OF MEMBERS--SALARY.--

A. Each member of the legislature shall receive per diem at the internal revenue service maximum federal per diem rate for the city of Santa Fe for each day's attendance during each session of the legislature and the internal revenue service standard mileage rate for each mile traveled in going to and returning from the seat of government by the usual traveled route, once each session as defined by Article 4, Section 5 of the constitution of New Mexico.

B. Each member of the legislature shall receive an annual salary of twenty-one thousand dollars ($21,000) payable in twelve equal installments on the first day of each calendar month."

Section 2. EFFECTIVE DATE.--The effective date of this act is the January 1 following the date that the secretary of state certifies that the amendment to the constitution of New Mexico proposed by the first regular session of the forty-fifth legislature and entitled "A JOINT RESOLUTION PROPOSING TO AMEND THE CONSTITUTION OF NEW MEXICO TO LIMIT LEGISLATIVE SALARIES TO THE AVERAGE PAID IN THE FIVE CONTIGUOUS STATES" has been adopted by the people.
