RELATING TO HEALTH CARE; CREATING THE CRIME OF UNLAWFUL BLOCKING OF HEALTH CARE ACCESS; PROVIDING PENALTIES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. UNLAWFUL BLOCKING OF HEALTH CARE ACCESS.--

A. Unlawful blocking of health care access consists of:

(1) willfully blocking or obstructing the entrance or any door of a health care facility;

(2) approaching nearer than one hundred feet to the entrance or any door of a health care facility while involved in expressive or symbolic conduct, including advocating, protesting, picketing, displaying of signs or distributing literature; or

(3) performing an act that interferes with or impedes the ability of people entering or leaving a health care facility.

B. A person who commits unlawful blocking of health care access is guilty of a fourth degree felony and shall be sentenced pursuant to the provisions of Section 31-18-15 NMSA 1978.

C. As used in this section, "health care facility" means a building regularly used by a person licensed pursuant to the laws of New Mexico to provide medical care or counseling to members of the public.
