Mr. Speaker:

Your ENERGY AND NATURAL RESOURCES COMMITTEE, to whom has been referred

HOUSE BILL 766

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 7, line 1, strike the period and insert in lieu thereof "; and".

2. On page 7, between lines 1 and 2 insert the following paragraph:

"(3) "damaging a fossil" does not include unintentional damage caused by a person engaged in activities authorized by the commissioner.".

3. On page 7, line 7, after the period insert ""Unlawful exchange of a fossil" does not include unintentional sales, purchase, exchange, transport or receipt of a fossil caused by a person engaged in activities authorized by the commissioner.".

4. On page 7, line 9, strike "fourth degree felony" and

insert in lieu thereof "misdemeanor.".

5. On page 7, lines 11 and 12, strike "fourth degree felony" and insert in lieu thereof "misdemeanor.".

6. On page 7, strike Subsection F in its entirety.,

and thence referred to the JUDICIARY COMMITTEE.
