Your TRANSPORTATION COMMITTEE, to whom has been referred



HOUSE BILL 916



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 2, strike lines 16 through 24 in their entirety and insert in lieu thereof the following:



"C. prescribe by rule the conditions under which utility facilities, including pipelines, electric power, telecommunications, irrigation and similar facilities, may be accommodated within public rights of way in the state;".



2. On pages 5 and 6, strike Subsections G and H in their entirety and insert in lieu thereof the following subsections:



"G. accommodate telecommunications facilities statewide, along, across, over or under public highway rights of way under the jurisdiction of the state by:



(1) encouraging the design, construction and maintenance of telecommunications facilities within public rights of way by the telecommunications industry, or encourage concurrent highway telecommunications facilities construction when appropriate; or



(2) entering into agreements with private or public telecommunications providers; and



H. prescribe by rule the conditions under which the department will accommodate telecommunications facilities within public highway rights of way pursuant to the federal Telecommunications Act of 1996."".
