AN ACT

RELATING TO ANIMALS; PROHIBITING COCK FIGHTING; ESTABLISHING CRIMES; PROVIDING PENALTIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of Chapter 30, Article 18 NMSA 1978 is enacted to read:

"[NEW MATERIAL] COCK FIGHTING--CRIMES--PENALTIES.--

A. Sponsoring a cock fight consists of a person causing, sponsoring, arranging to hold, providing facilities for or knowingly participating in the organization of a cock fight.

B. Participating in a cock fight for the purpose of monetary gain or entertainment consists of an adult knowingly owning, training, equipping, sponsoring or in any way causing a cock to participate in a cock fight.

C. Being present at a cock fight consists of an adult being at a location or facility where a cock fight is occurring for monetary gain or entertainment and not taking action to interfere with or stop the cock fight.

D. A person who commits sponsoring a cock fight is guilty of a fourth degree felony.

E. A person who commits participating in a cock fight for the purpose of monetary gain or entertainment is guilty of a fourth degree felony.

F. A person who commits being present at a cock fight is guilty of a misdemeanor.

G. As used in this section, "cock" means a male member of the genus Gallus, bred and trained for fighting."

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
