Your CORPORATIONS & TRANSPORTATION COMMITTEE, to whom has been referred
has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:
1. On page 1, line 12, after "SOFTWARE" insert "DEVELOPMENT".
2. On page 1, line 19, after "SOFTWARE" insert "DEVELOPMENT".
3. On page 1, line 21, after "software" insert "development".
4. On page 1, line 24, after "software" insert "development".
5. On page 2, line 1, after "software" insert "development".
6. On page 2, line 6, strike "forty" and insert in lieu thereof "fifty".
7. On page 2, strike lines 8 through 10 and insert in lieu thereof:
"(3) "software development services" means custom software design and development and web site design and development, but does not include software implementation or support services.".
8. On page 2, between lines 10 and 11, insert the following new subsection:
"C. In the 2006 interim, the taxation and revenue department and representatives of the software development industry shall report to the revenue stabilization and tax policy committee and the legislative finance committee on the fiscal and economic impacts of the software development services deduction provided in this section. The report shall include data on the use of the deduction, the geographic locations of eligible software companies claiming the deduction and the increases in payroll and number of software development companies in qualified areas in the state since enactment of the deduction. The committees shall report their findings and any recommendations to the first session of the forty-eighth legislature."",
and thence referred to the FINANCE COMMITTEE.
