RELATING TO MOTOR VEHICLES; LIMITING ENFORCEMENT POWERS OF MOTOR TRANSPORTATION DIVISION ENFORCEMENT EMPLOYEES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 65-1-7 NMSA 1978 (being Laws 1998 (1st S.S.), Chapter 10, Section 6) is amended to read:

"65-1-7. ENFORCEMENT EMPLOYEES OF DIVISION ARE POLICE OFFICERS.--The enforcement employees of the division designated by the director of the division are police officers as defined in Section 29-7-7 NMSA 1978; provided, however, that enforcement employees shall not enforce provisions of the Motor Vehicle Code against drivers of private passenger motor vehicles."
