SENATE PUBLIC AFFAIRS COMMITTEE SUBSTITUTE FOR

SENATE BILL 156, as amended



has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:



1. On page 2, line 1, strike "or health care provider authorized" and insert in lieu thereof "by an authorized health care provider".



2. On page 2, line 2, strike the second occurrence of "or" and insert in lieu thereof "and".



3. On page 2, line 3, strike "by" and insert in lieu thereof "through".

4. On page 5, line 6, after "services" insert "and alternative courses of treatment".



5. On page 5, line 7, strike "unique circumstances, including".



6. On page 5, line 8, strike the comma and on line 9 after "service" insert "or alternative course of treatment".



7. On page 7, line 19, after the period insert "Nothing in this section shall be construed to prohibit a risk-bearing entity from making medical or utilization review determinations.".



8. On page 7, line 22, before "The" insert the subsection designation "A.".



9. On page 7, line 25, strike the comma and insert in lieu thereof a period.



10. On page 8, lines 1 and 2, strike "except to health care providers making decisions while directly providing services to a person.".



11. On page 8, lines 4 through 11, strike the subsection designations "A." through "E." and insert in lieu thereof the paragraph designations "(1)" through "(5)".



12. On page 8, line 12, strike the closing quotation mark.



13. On page 8, between lines 12 and 13, insert a new subsection as follows:



"B. Nothing in the Medical Necessity Act shall be construed to apply to a health care provider making decisions while directly providing services to a person."".,



and thence referred to the CONSUMER AND PUBLIC AFFAIRS COMMITTEE.
