AN ACT

MAKING APPROPRIATIONS FOR SPECIAL PROGRAMS FOR HOMELESS CHILDREN AND FAMILIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--Two hundred thousand dollars ($200,000) is appropriated from the general fund to the department of finance and administration for expenditure in fiscal year 2002 to allow the state housing authority to establish a homelessness prevention program. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.

Section 2. PROGRAM--RULES.--

A. The appropriation provided in Section 1 of this act is for housing assistance to families and individuals to prevent eviction or foreclosure by providing short-term rental assistance, mortgage payments and rental deposits. There shall be no more than three months' rental assistance or mortgage payments per household.

B. The state housing authority shall establish rules to implement and administer the homelessness prevention program, including establishing an income ceiling of no more than thirty-five percent of the New Mexico median family income.

Section 3. APPROPRIATION.--One hundred thousand dollars ($100,000) is appropriated from the general fund to the children, youth and families department for expenditure in fiscal year 2002 for special child care for homeless children, to include group, individual and play therapy activities that address special circumstances of homeless children and families. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.
