AN ACT

RELATING TO TELECOMMUNICATIONS; ESTABLISHING PARITY OF INVESTMENT IN LOCAL EXCHANGE AREAS BEFORE SALE PERMITTED BY THE PUBLIC REGULATION COMMISSION.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the New Mexico Telecommunications Act is enacted to read:

"[NEW MATERIAL] PARITY OF INVESTMENT IN LOCAL EXCHANGE FACILITIES PRIOR TO SALE APPROVAL.--The commission shall not approve or permit the sale of local exchange facilities, pursuant to Section 63-9A-6.2 NMSA 1978 or otherwise, by a telecommunications company serving more than eighty thousand access lines in this state, unless and until the local exchange system capabilities, switching technologies and related facilities of the local exchange to be sold are equal to or greater than the capabilities, technologies and facilities of the seller telecommunications company's largest local exchange in the state."
