AN ACT

RELATING TO CORRECTIONS; PROHIBITING THE PLACEMENT OF OUT-OF- STATE INMATES IN NEW MEXICO CORRECTIONAL FACILITIES OR JAILS; ENACTING A NEW SECTION OF THE NMSA 1978.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. PROHIBITING THE PLACEMENT OF OUT-OF-STATE INMATES IN NEW MEXICO CORRECTIONAL FACILITIES OR JAILS.--

A. Except as authorized in Chapter 31, Article 5 NMSA 1978, out-of-state inmates shall not be incarcerated or detained in municipal or county jails, state-run correctional facilities or privately owned correctional facilities in New Mexico.

B. The provisions of Subsection A of this section shall not be interpreted to prohibit or authorize the incarceration or detention of federal inmates in jails or correctional facilities in New Mexico.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
