AN ACT

RELATING TO MOTOR VEHICLES; PROHIBITING THE FAILURE TO PROVIDE PAYMENT FOR FUEL DISPENSED INTO A MOTOR VEHICLE; PROVIDING PENALTIES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Motor Vehicle Code is enacted to read:

"[NEW MATERIAL] MOTOR VEHICLE--FUEL DISBURSEMENT--FAILURE TO PAY.--

A. It is unlawful to dispense fuel into the tank of a motor vehicle and fail to provide payment for the fuel dispensed.

B. Whoever is convicted of dispensing fuel into the tank of a motor vehicle and failing to provide payment for the fuel dispensed is guilty of a misdemeanor."
