AN ACT

MAKING AN APPROPRIATION TO PROVIDE TECHNICAL ASSISTANCE IN TESTING, ASSESSMENT, INTERPRETATION AND ANALYSIS OF TEST RESULTS TO IMPROVE NATIVE AMERICAN STUDENT ACADEMIC ACHIEVEMENT AND PERFORMANCE IN STATEWIDE STUDENT ASSESSMENT PROGRAMS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Three hundred thousand dollars ($300,000) is appropriated as follows from the general fund to the state department of public education for expenditure in fiscal year 2002 to improve Native American student academic achievement and performance in the state assessment program:

(1) one hundred fifty thousand dollars ($150,000) to be used by the department to contract with experts in assessment and testing; and

(2) one hundred fifty thousand dollars ($150,000) to be distributed to public schools that:

(a) have the highest proportion of Native American students;

(b) submit an academic and performance improvement plan to the state department of public education; and

(c) receive approval of their academic and performance improvement plan from the state department of public education.

B. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.
