AN ACT

RELATING TO LIQUOR SALES; PROHIBITING A PERSON FROM CONSUMING ALCOHOLIC BEVERAGES WHILE ON DUTY AS AN EMPLOYEE OF A LIQUOR LICENSEE.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Liquor Control Act is enacted to read:

"[NEW MATERIAL] OFFENSE BY EMPLOYEE OF LICENSEE--CONSUMING ALCOHOLIC BEVERAGES WHILE WORKING--DISORDERLY CONDUCT.--

A. It is a violation of the Liquor Control Act for a licensee, lessee or an employee of a licensee or lessee to consume alcoholic beverages while mixing, pouring, serving, selling or delivering alcoholic beverages to a customer or at any time during the course of his shift of employment.

B. It is a violation of the Liquor Control Act for a licensee, lessee or an employee of a licensee or lessee to be intoxicated or acting in a disorderly manner while on the licensed premises of the licensee."
