AN ACT

RELATING TO HIGHWAYS; PROHIBITING NEW PERMITS FOR OUTDOOR ADVERTISING FOR GENERAL ADVERTISING PURPOSES; DECLARING AN EMERGENCY.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. Section 67-12-1 NMSA 1978 (being Laws 1966, Chapter 65, Section 1) is amended to read:

"67-12-1. SHORT TITLE.--[This act] Chapter 67, Article 12 NMSA 1978 may be cited as the "Highway Beautification Act"."

Section 2. A new section of the Highway Beautification Act is enacted to read:

"[NEW MATERIAL] PERMITS PROHIBITED.--

A. After the effective date of this 2001 act, construction of new outdoor advertising for general advertising purposes is prohibited, and the state highway commission shall not issue any new permits for such purposes.

B. For purposes of this section, "general advertising" does not include outdoor advertising as provided in Paragraphs (1) through (3) of Subsection A of Section 67-12-4 NMSA 1978."

Section 3. EMERGENCY.--It is necessary for the public peace, health and safety that this act take effect immediately.
