AN ACT

RELATING TO THE PRACTICE OF MEDICINE; ENACTING A NEW SECTION OF THE MEDICAL PRACTICE ACT; PROHIBITING DISCIPLINARY ACTIONS BASED ON CERTAIN PRACTICES.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. A new section of the Medical Practice Act is enacted to read:

"[NEW MATERIAL] LIMITATION ON DISCIPLINARY ACTS.--The board shall not discipline a physician by:

A. reprimanding, sanctioning, placing on probation, censuring or fining based solely on that physician's practice of providing nonprescription health-related treatments, nontraditional therapies or alternative medical care that departs from the prevailing medical practice;

B. suspending, revoking, placing stipulations upon or denying a license based solely on that physician's practice of providing nonprescription health-related treatments, nontraditional therapies or alternative medical care that departs from the prevailing medical practice; or

C. charging with unethical behavior, unprofessional conduct or incompetence based solely on that physician's practice of providing nonprescription health-related treatments, nontraditional therapies or alternative medical care that departs from the prevailing medical practice."
