AN ACT

MAKING AN APPROPRIATION TO THE CORRECTIONS DEPARTMENT

TO PLAN AND DESIGN A MEDIUM SECURITY CORRECTIONAL FACILITY IN LOS LUNAS.



BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF NEW MEXICO:

Section 1. APPROPRIATION.--

A. Three million seven hundred fifty thousand dollars ($3,750,000) is appropriated from the general fund to the corrections department for expenditure in fiscal year 2002 to plan and design a five-thousand-bed medium security correctional facility in Los Lunas.

B. The facility shall be designed so that:

(1) there are two beds in each cell;

(2) eighty-seven percent of the facility's cells are dedicated to housing inmates classified as level 3 and level 4 in the correction department's classification system;

(3) six percent of the facility's cells are dedicated to housing inmates assigned to administrative segregation;

(4) two percent of the facility's cells are dedicated to housing inmates assigned to protective custody;

(5) two percent of the facility's cells are dedicated to housing inmates assigned to medical custody;

(6) two percent of the facility's cells are dedicated to housing inmates assigned to mental health custody; and

(7) one percent of the facility's cells are dedicated to housing inmates who are unclassified.

C. The facility shall be designed to include:

(1) an infirmary;

(2) a kitchen;

(3) educational facilities;

(4) vocational facilities;

(5) a room for community and religious programs; and

(6) a family visitation area.

D. Any unexpended or unencumbered balance remaining at the end of fiscal year 2002 shall revert to the general fund.

Section 2. EFFECTIVE DATE.--The effective date of the provisions of this act is July 1, 2001.
