Mr. President:

Your JUDICIARY COMMITTEE, to whom has been referred

has had it under consideration and reports same with recommendation that it DO PASS, amended as follows:

1. On page 2, between lines 11 and 12, insert the following new subsection:

"E. "motor vehicle manufacturer" means a person who:

(1) manufactures or produces motor vehicles and sells motor vehicles under its own name or label; or

(2) is a wholly owned subsidiary of the person who manufactures or produces motor vehicles;".

2. Reletter the subsequent subsections accordingly.

3. On page 2, line 16, after "holder" delete the remainder of the line in its entirety and on line 17 delete everything through "or".

4. On page 4, line 24, after the period insert "The provisions of this section shall not apply to motor vehicle manufacturers' service contracts."

5. On page 5, between lines 18 and 19, insert the following new subsection:

"C. The provisions of this section shall not apply to motor vehicle manufacturers' service contracts."

6. On page 6, between lines 23 and 24, insert the following new subsection:

"E. The provisions of this section shall not apply to motor vehicle manufacturers' service contracts."

7. On page 14, between lines 7 and 8, insert the following new subsection:

"D. The provisions of this section shall not apply to motor vehicle manufacturers' service contracts."

8. On page 14, between lines 21 and 22, insert the following new subsection:

"C. The provisions of this section shall not apply to motor vehicle manufacturers' service contracts."
